Purchased item that the seller does not want to honor and filed an inaccurate cancelation

I just purchased an item advertised with free shipping.  The seller did not like that I took the free shipping option so cancelled the sale stating a false reason of shipping address issues.  The vendor then re-posted the item removing the free shipping option.  In fact vendor put shipping at $199 USD, then re-posted again a few moments later with shipping at $139 USD.  The vendor is intentionally underpricing the item then charging excessive shipping to compensate.  Although this appears standard operating procedure, vendor posted item with free shipping and will not honor.

 

Vendor is shophere_direct.

 

I would like to know what ebay will do with a vendor that does not honor a legitimate contract sale.

You're in Canada. Maybe the seller cancelled because shipping is not usually free to International buyers.  Was the item location in the US?

The seller is in China, I have purchased similar product from various sellers from the same region before.  This is purely a seller that does not want to honor the contract.

 

As per contract/tort law, there was a binding agreement.  The buyer agreed to the purchase and buyout amount, the seller accepted same and processed the monies thru paypal.  The vendor then identified they made an error and cancelled the sale which is identified as a bait and switch or false transaction.  Under contract/tort law there was a binding agreement that the seller did not want to honor.  Please note, when a buyer purchases an item with no additional conditions a contractual arrangement is created and the vendor and buyer both have an obligation to complete the transaction.  In the event one party does not complete the transaction and, in this case, rescinds on the transaction and reposts for the same transaction, that vendor can then be taken to small claims court for violation of contract.  

 

A vendor cannot arbitrarily stop a transaction that was agreed, i.e. cancel the transaction, and then repost for a higher price.  This is classified as a bait and switch and the vendor can be taken to court for such action.

 

That said,  you can look up the vendor on your own, enter the code L900 Pro in search and the new terms can be viewed.  Please note, the new terms are not the terms associated to the purchase I contracted.

I should make note that I appreciate your attempts at assistance.  I do not believe that any true assistance would be fourth coming as I believe this is a scam the ebay permits of it's vendors.  From the indications on this forum it seems that vendors do this consistently with no/limited recourse.

 

I have seen some of your other posts on vendors that have done something similar and the only answer I could give is that backing out of a contractual agreement is not legal but also most persons are not willing to take someone to small claims court.

 

In this situation the proper resolution is that ebay causes the vendor to complete the agreed to transaction as per the agreed to terms.  This is unlikely to happen but is actually the logical outcome. 

 

That said this forum community is mostly a method to appease persons with little to no actual validity to solving an issue.  ebay has stopped it's true customer services and complaints lines both on web and telephone.  If I could I would post a buyer warning and negative feedback against the seller but because of ebay processes i cannot post a negative feedback for a transaction that the vendor arbitrarily decides to not complete.

EBay will probably give them a defect unless they lied about the reason for cancelling the transaction. You're best is to stay away from sellers like this.
