Product arrived on time. Didn't open for several months; return window is Closed. Product is damaged

Product is set of DVDs, most of which skip, lock, pause, sound drops out,  and seller is okay with a refund, but eBay's avenue to process a refund is no longer available. Seller has been super helpful, but his hands are tied. Other than never using eBay again (I'm out $60), do I have any options to appeal to eBay for special exemption?

Repeat: Seller will process a refund, but currently cannot.
