Has anyone encountered a seller that is dishonest and rude?

Once you start a claim with your payment provider, any eBay claim is automatically closed, and eBay will no longer be able to help you.

 

Since you have started a claim with PayPal, pursue that claim. Be sure that you make it clear that the seller has provided false tracking. A standard "item not received" claim will not work for you, since the seller has tracking that appears to show delivery.

 

Had you not started a claim with PayPal, you would have been able to pursue a claim through eBay via social media. See the following for how that works; you may be able to use some of the information in the solution to this thread in your PayPal claim.

What kind of feedback does your seller have?

 

You can avoid many fake tracking issues by choosing to only do business with experienced sellers that have a proven track record of delivering similar items as seen by examining the seller's feedback page, and by avoiding inexperienced sellers, sellers with patterns of negative feedback indicating serious problems, or sellers with large gaps in the selling history or recent drastic changes of seller behavior.

Sure sellers on eBay are no different than sellers everywhere.  You will find most sellers on eBay honest and dependable but there will always be those that are not.  You have the eBay Money Back Guaranty to protect you but there is a time limit and some restrictions for eBay to help.  On any listing click on the Money Back Guaranty icon to see how to use the guaranty.  Even if the seller says No Returns as long as the item is not as described you can use the guaranty.

 

Keep in mind that the Money Back Guaranty does not apply to vehicle sales.

There is somewhere around 17 MILLION Selling accounts on eBay.  Sadly, there are rude Buyers and Sellers on ALL internet sales venues.  If your situation was BEFORE a purchase then it is best to look for another Seller.

If the situation was AFTER a purchase please share the details because most likely you want a refund, return, damages addresses, inaccurate pictures or description addressed, mis-delivered package situation, etc.

Something else to keep in mind, your Feedback history shows you have left both Neutral and Negative Feedback for Sellers in the past.  In 2008 eBay stopped allowing Sellers to leave less than Positive Feedback for their customers.  Most Sellers are sensitive to getting less than Positive Feedback so when they see a Buying account that leaves less than Positive FB for other Sellers they may get concerned that it could happen to them and negatively impact their sales ...

I am a longtime user and reliable buyer of EBay.  I do not know who you are that you can see my review pattern. I leave truthful feedback. This incident is wholly the sellers fault. My delivery address was wrong on the pkg. the seller used insults and called me a liar. In the end, the seller had to admit that there was a problem and it was his fault.  I just want my money back and to put this in the rear view mirror. Are you actually Ebay hiding behind a name here in the Community?

That said, have you filed a claim from your Purchase History for an ‘item not received’?  

 

I’m assuming (from your post) that you had the correct address on your Checkout payment … and the seller used a different address for some reason.  If that is the case, you should have no problem getting refunded.

 

If the situation is somewhat different … then please provide the missing details.

 

[I didn’t think it would be helpful telling you about my rude sellers …  since I usually ignored them and simply filed the appropriate claim for a refund.]

When I got notice that my pkg had been delivered, I went to my front porch and mailbox to get it. It was not there.  I went online and found a reference to it having been left beside the garage. So, I looked all around my garage but the pkg was not there.  Next I contacted the seller.  They insisted that it had been delivered.  I looked again and messaged them that it assuredly was not here.  The seller’s response grew increasingly rude implying that I was lying, and then that God would punish me, and finally accusing me of trying to cheat the seller.  I make all purchases via PayPal so I turned to them for help.  When they contacted the seller they got the delivery notice from FedEx but not the delivery pic.  So they closed my dispute.  I investigated further and found the FedEx delivery pic. It was not my garage. I told the seller that my garage has a cinder block foundation and the one I. The pic was brick.  All I got was more insults.  That is when I turned to EBay. Ebay contacted the seller who told them that I had filed with PayPal.  So EBay closed my claim. I called both PayPal and Ebay and explained to both that the pic did not show my garage.  Ebay still claims that they cannot help because PayPal was contacted despite the pic.  Finally, the seller admitted that the package was address wrong and delivered somewhere else.  FedEx will not tell me where so I can retrieve it.  My last communication with EBay was to point out that the seller had also violated their own standard of seller conduct.  So, I am stuck.

None of the replies have helped me. I still do not have my pkg or a refund.  Neither EBay or PayPal have helped. Each one stands on ceremony while the seller gets away with what he has done.

Hi @tweesaj 

You should be able to get FedEx to  send a statement (attached to an email) saying that your name and address were NOT on the package associated with the tracking number you were given.  Try phoning FedEx at 800-463-3339 … and ask to speak to someone who handles ‘fraud complaints’.

 

Once you receive the statement, phone your credit card company, explain the situation, and request a chargeback.  Ask the agent how to provide your evidence.

I’ve been the victim of several fake tracking number scams, and I’ve obtained a refund in every one.  Good luck!

Already called FedEx. They will not help.  Won’t tell me where the pkg went because in their eyes it was addressed to that place and delivered there.  I asked to speak to a manager but the customer er svc agent said no.  I said I would call corporate. He said go ahead.

You don't need to know where the package went.

 

You only need documentation that says it was not addressed to you, or something like the weight or date that proves it cannot be for your order (too light to be your item, way too heavy, or generated before your placed your order).

 

Contact different FedEx offices until you find one that will help you.
