Since I opened a case for a missing item, eBay says I got the item and I am not eligible for a refund. But the item was listed as new with tags and it isn’t.
How do I get eBay to address my new complaint?

Let the claim run its course, the Seller has 3-4 days to respond to the claim by uploading the tracking number. If they don't you can go back and have eBay close the claim and refund you.
If the Seller uploads a valid tracking number and eBay closes the claim then you can file the other return claim previously mentioned.

I followed your recommendation. I closed the case about not receiving the item. I opened a new case about the item not as described and immediately got a return label and a full refund.
