NIB item doesn't work...

Hi.

 

I purchased a NIB electronic item for a birthday gift about 1.5 months prior to the day it was to be given.  It arrived NIB, no crushing, no damage I could see to the box.  After opening and trying to charge, I found out that the device doesn't even hold a charge in any way, as if the battery was totally faulty.  Ebay has a refund policy that can apparently be used, even if the seller doesn't accept returns (he doesn't, and understandably so).  If I were to go this route, will the seller be docked the money on the refund?  It wasn't his fault it was faulty; how could he have known?

Buyers have 30 days to request a return for an item that doesn't match the listing.

 

After these 30 days the buyer needs to use their payment issuer.

Sellers are responsible for what they offer.

 

So you can request a return, within 30 days, for an item that doesn't match the listing.

 

After these 30 days you can try your payment issuer.

Yes the seller will have to pay for the refund. 

The seller is responsible to deliver the item in the condition that was described.
