Listing used engine parts as new

Hello, I recently purchased a boat stator that was listed as new. When I received the part it was quite obvious

that the part was used and had been painted over to cover up the fact that it was used. The attaching points had screw and washer marks and the part had the original factory part number that had been painted over.

I have requested a return and I'm still waiting for a response from the seller. The seller sells outboard parts and had a 100% feed back rating. I also purchased from the same seller a few days later another outboard part, a timer base that goes with the stator. It was also listed as new. I am starting a outboard-boat rental business and have clients relying on me to have dependable boats. 

I don't understand how someone who is in the parts business can sell a used part as new. When I buy a new part from the auto parts store  I always take the part out and inspect it. In this case I was trusting someone else to do that. I haven't received the timer base but comparing the listings of my two purchases, I suspect the timer base is used also. Both listings had the original oem boxes that the parts would have been shipped in. I think since these two parts go together, they were replaced and the old parts were put back in the original boxes. I don't think it was an honest mistake. Mainly because the stator is a non-serviceable part, and If I'm in the outboard parts business I would know that.

Once you file the Returns Request, the seller has 3 days to accept the return and supply a prepaid return shipping label, or refund you in full and not require return of the item.  If he does neither, on day 4 go back to the case and click Ask ebay to step in, to force the refund.

Thank you, they sent a return label yesterday. I usually don't spend a lot of time investigating people to see if they pass the honesty test-with a 100% feedback rating I don't see a need to look further. The price was good for a new part and it's a hard to find part. Yesterday I looked at the sellers feedback and noticed they had 15 neutral feedback comments, four of them stated, "Sold used part as new".  Three of these kept the part and used it, one threw it in the trash and said "live and learn".

I have a feeling there will be more to follow.

I received the other ignition part today and it was a used part. Looks like I'll be returning the part and starting over.
