Item condition definitions

Trying to understand if ebay condition definitions are trustworthy

 

An "Open Box" condition cell phone I just viewed is further described thus: "

DESCRIPTION:

Fair 6/10: The device will have excessive wear and tear on screen, body and backdoor such as deep scratches on the screen and dings/dents and scratches on the body and backdoor, Fair cosmetic condition 6/10. NO CRACKS

 

Yet eBay's definition for an Open Box condition is:  "An item in excellent, new condition with no wear. The item may be missing the original packaging or protective wrapping, or may be in the original packaging but not sealed. The item includes original accessories. The item may be a factory second. See the seller's listing for full details and description."

So, according to eBay, this is not an Open Box item. But should be listed as "used" instead:

"Used -An item that has been used previously. The item may have some signs of cosmetic wear, but is fully operational and functions as intended. This item may be a floor model or store return that has been used. See the seller's listing for full details and description of any imperfections."

I often browse electronics on ebay so, I know that this is not an isolated incident, but it may still be fairly rare.

Does anyone else run into this? Is it old news or still a rare thing? Can the listed item's condition definitions be trusted?
