I bought something from the US and I live in Europe. The item was defective and the seller admitted he didn't check it beforehand. He said he cannot refund my shipping and tax charges as E Bay only lets him refund the purchase price. He told me to contact E Bay but I am finding it impossible to find this topic anywhere, they won't call me as I am not in US, and they won't answer calls. LIve chat also useless as it's all AI. Help please.

You should open a Return Request. The reason could be "Item is defective", "Arrived damaged", "Missing Parts" OR "Doesn't Match photos and description" if the item you got was not what was shown and described.
You can open your return request here. Just click the photo and follow the instructions.

The seller will not be able to provide a label, but you can insist that they send you the cost of the label.
