Through no fault of my own, I have paid for an item, but there is an issue with the buyer, whose bank account ebay are unable to take their listing fee from, and without this, the buyer can't cancel my order. My payment is being held in limbo in ebay. Any suggestions?

I am assuming that you made a mistake in your post here and meant to refer to the seller, not "buyer"?
The problem with the seller's account is not your problem.
You can file a refund request 1 day after the lastest estimated date of delivery has passed:
