How to restrict purchases from California for items that are banned from that state?

I sell Rabbit fur lined leather gloves. I know that California has banned this item from sales to their state.

I know that Amazon restricts the sale on its own.

I know that Walmart restricts the sale on its own.

forgot about eBay sales and just saw and order come through. How do I cancel the order and how do I prevent it from happening again from California buyer? would like to continue selling to rest of the states.

@yogimendy  There is no way to block sales to a state, other than Alaska and Hawaii.  

 

I do not see any mention of rabbit on the CA code not allowed list for animal products>

The only way to cancel the sale is you have to cancel as out of stock, then you get a DEFECT on your account and do not get your sellers fees back.

 

You can ask the buyer if they are aware of the law and if they want to cancel.  Then if they say yes please cancel you can cancel as buyer requested to avoid the defect.  You can NOT cancel as buyer requested unless they actually do ask though.

California Ban on the Sale of New Animal Fur Products Takes Effect

California’s ban on the sale and manufacturing of new animal fur products officially went into effect on Jan. 1, 2023, making it the first state to officially end the fur trade within its borders through amendments to Sec. 2023 and Sec. 3039 of the Fish and Game Code. The new law only applies to the sale of new fur garments, making it “unlawful to sell, offer for sale, display for sale, trade, or otherwise distribute for monetary or nonmonetary consideration a fur product in the state” (Cal. Fish & G Code Sec. 2023(b)(1)) and “unlawful to manufacture a fur product in the state for sale” (Cal. Fish & G Code Sec. 2023(b)(2)). It explicitly does not affect the sale of used fur products (Cal. Fish & G Code Sec. 2023(c)(1)), which would permit the ongoing sale of used fur products by consignment, nonprofit thrift stores, secondhand stores or pawn shops, subject to the requirement that the seller must maintain a record of each sale for at least one year. (Cal. Fish & G Code Sec. 2023(d)). It also explicitly excludes the sale of items made with other animal products, such as leather or shearling (Cal. Fish & G Code Sec. 2023(a)(2)(B)). With respect to the sale of used fur products, penalties include up to $500 for the first violation, $750 for a violation that occurred within one year of a previous violation and $1,000 for a violation that occurred within one year of a second or subsequent violation (Cal. Fish & G Code Sec.2023(e)(1)(A)-(C)). The statute does not directly address the question of the repair of previously purchased fur products. However, since it explicitly does not apply any of the prohibitions to “used fur” products (Cal. Fish & G Code Sec. 2023(c)(1)), a consumer should have the right to send a previously purchased, used fur product to a business for repair. Additionally, the law does not impact fur ownership rights, and it remains legal to wear fur garments in the state. There has been no material update and no case law involving this legislation.

@yogimendy  Sorry I see that there's a newer law than what eBay has linked in the animal policies page.  I'll be sure to advise eBay to update the link.    Do you happen to a .gov page with the new law?  I did a search and only see references to it on other sites.  

 

As I said though there's no way to block buyers from CA.   You can put a note in the description citing the CA law and let buyers know that way that you can't ship to CA.  

 

I was discussing the cancelation reasons with a fellow mentor and you should be able to use problem with buyers address for the cancelation reason.  Do NOT cancel though until you explain to the buyer and apologize that you can't ship to them.   Buyers get upset if you cancel without talking to them.

thanks for your help - I think this a bigger issue that eBay should manage at a state level like all other platforms.

I see this being a real pain - so I will delist those items off ebay
