How does this feedback follow eBay policy ? EBay refuse to remove

“Never arrived, seller can barely speak English properly and eBay are going to force a refund. Terrible. Don't waste your time and money with this pleb”

item isn’t due for arrival till 21st as they selected 2nd class post 

I have asked for removal and received this response
