Ebay Authentication return

I recently purchased a luxury bag through ebay authentication. When it arrived I did not find anything wrong at first glance. But next day when I was ready to wear it I found a small stain. It was only visible under the light, but such a stain was not in the picture or description so I thought it is a major defect with a luxury bag like this. I then sent out the picture and returned it to ebay authentication as "item not as described".

When I was returning it I made a call to ebay to explain the situation, and as I was reading the email I noticed that the return should contain the original tag. I don't remember if there was a tag when I received (since I bought many items recently), but if there was it is possible that I removed it and threw away since I tend to throw away tags once I receive the item (which is a very stupid habit I know, I regret it very much now). Everything else was there though, including packing box and authentication card. 

The seller refused to return (the seller had no return policy), They then claimed that the bag in the picture I sent is not the same bag they sent out and they believe I'm a scammer. I thought it was absurd at first and told them it is the exactly same bag. But now I'm worried: If I really threw away the tag, would they really think it is not the same item and refuse my return? If so what options do I have, can I still contact my bank for a possible charge back?

@yunso60   regardless of authentication, if a buyer wants to return an item, they are required to return it in the same condition as received.

 

missing tag(s), especially on a luxury bag, is major. without the tag(s), it makes it more unlikely that the bag can get authenticated and a buyer would not appreciate receiving this item tagless.

 

ebay policy> When returning an item, the buyer will send it back to the authenticators who will check that the item is still in the same condition and has all relevant accessories. Once the item has been re-authenticated, it will be returned to you (seller) and the buyer's refund will be processed.

 

If the buyer returns your item, the authenticators inspect it before sending it back to you so you’re (seller) protected.

 

can u try working it out with the seller?

Ebay Authentication return

Thank you for the reply. I did try to communicate with the seller and explain the situation but they seem to insist that the my bag in my picture is a different bag... I will try to keep communicating with them but I dont think it'll work out.

As for the tag, yes I do realize my habit of removing tag is stupid and creates more trouble for myself... but I believe the tag is not included by the seller (like there is no tag in item description or picture), so it is added by ebay authentication. So would it be possible for them to just authenticate it again and add that tag? Like the tag itself is not included in "original condition" by the seller... Sorry I might be too ideal here. 

If all those doesnt work out, what other options would I have? I really dont want to keep a bag with major defect... Thank you!
