Against terms of service?

A seller has an item listed for $49.99 OBO. When I contacted him with an offer he stated that he would sell it to me for $75 plus shipping. Is that against eBay TOS? And, if so, how do I report him.

Maybe the seller doesn't want to accept offers.

Sometimes Ebay will add best offers to listings, when the seller doesn't want it.

So what you are saying is that even though the seller has a buy it now price of $49.99, they can demand way more than what they have the BIN price for?

No.   To get the BIN price you have to use the BIN button (or Add to Cart and pay).   A seller making a counteroffer higher than the BIN price is usually trying to send a message to the offeror.

Yes. I am familiar with the BIN offer. I have been using eBay since 2000.
