Ordered iphone listed as New , Seller didn't shipped Earphones.

Ordered iphone listed as New , Seller didn't shipped earphones. Now he is arguing that he haven't mentioned any thing about earphones inclusion/exclusion in the description.

AFter purchase received an email from ebay saying seller is fraudulent.
