So long story short, I was able to win in the end. I said the right things, did the right things, and was smart enough to win. It's possible, just exhaust all options, take photos, and yeah....it is very much possible.

How did I sell something that was damaged? Interesting...I wonder if I can report him to the police for fraud? At least start a paper trail on the person.

If ebay cared they would make sure the buyer takes more photos of the product. Then the sell can analyze the product and report to ebay where the problem is. Ebay SHOULD then investigate. If the buyer modified something. Simply put ebay does nothing....
