for items shipped to NJ shipping charges are NOT subject to the sales tax. Why ebay collects sales tax for entire order????

Can somebody advice how to ask eBay to suspend and ban seller? this seller managed to get over 1000 negative feedbacks in last month and it's still active on ebay... ordered 4 items, recieved 3, send email etc... not responce, not way to contact sell...
