Can a chocolate company sell fudge that ingredients include rum; but the alcohol is cooked out?

Hi,We are a chocolate products company offering a variety of alcohol-infused fudges. During the cooking process, the alcohol is cooked out. Our slogan is "All of the flavor without the buzz. Can these products be offered on ebay? Thanks!!
