what should I do ?

ok so on March 24th 2021 ups and eBay set me a notification and said that my package was delivered to my front porch . I went outside to see if my package was out there I looked there was no package on my front porch there was no package on my side porch I even looked at my neighbor's Porsches and I still didn't see no package . at that point I knew something was up so I went to contact TracFone/seller TracFone never responded . so at that point in time I opened up a case through PayPal I also opened up the case through eBay . TracFone has yet to respond to either one of them. everytime I try to go look at a package on eBay they say service error to  make a long story short should I wait until friday before I file a claim  through UPS or should I give them until Friday to  deliver the package if there was a technical difficulty ?

Contact UPS I guess... maybe they sent it to the wrong house... hopefully you have honest neighbors if that is the case...  

 

You mentioned TracFone.... I don't think you're gonna have any luck with them, because they have nothing to do with the delivery of the package.

 

Unfortunately though, if it was mis-delivered but the tracking says "delivered" you might be out of luck with an eBay case because as along as it says delivered and the seller didn't edit the shipping address on the label, eBay won't find in your favor and refund you.  Not sure about how PayPal will handle a case like that.

This is very dishonest, getting a double refund from PayPal and eBay at the same point in time!

 

You should only open one case at a point in time, first with eBay at that point in time, and then if at any point in time it fails, open a case with PayPal at another point in time. It's possible now at this point in time, that you won't get no refund from either PayPal or eBay if they see your neighbor's Porsches.

There was no point in opening a case anywhere since OP states tracking shows delivery.

OP needs to contact the carrier who marked it as having been delivered.

You need to contact UPS IMMEDIATELY and find out exactly where your package was delivered.

Opening a case with Paypal and/or eBay is pointless because there evidently is tracking proving delivery.

And, for future reference, you should never open a case with both at once.

I'll give the "retentive" answer to this.

 

First, please be aware that as a buyer on eBay you are "protected" by the Money Back Guarantee (MBG).  This is one of the strongest protections for online buyers anywhere.  So as a buyer you want to stay protected by the MBG and use that protection to your advantage.

 

Now that said, eBay has a policy that many are not aware of, but IF  buyer opens a 'case" with PayPal or their CC Company, eBay immediately and permanently closes any "case" opened with eBay - buyer loses the rich MBG protection.  So instead of multiple cases, one should do them sequentially.  That means run a case to ground with eBay FIRST and only IF that fails, then go open a "case" with PayPal.   Yeah, I get it!  I was always trained to open multiple fronts to start with, but unfortunately that doesn't work here with eBay.  Sigh.

 

Now in a situation that you have experienced, I have done this before and am in the middle of a similar situation right now....

 

The "fix" to this is to go to the shipper and get the address (GPS Coordinates) for where the package was scanned as "delivered".   Often FedEx and UPS will not share that information if the address is not yours.   They can however, verify that the delivery address is NOT your address.    IF the delivery scan is indeed you address then there might have been porch piracy or someone in the household or 'hood helped you out and scooped the package - in that case seller isn't responsible.   IF the delivery scan is not at your address, then you will need to get a letter from the shipper:
 
• on shipper letterhead
• signed by an employee (with printed name of course)
• contact info for Shipper employee, so eBay can call & verify
• letter should state the tracking number & address where package was delivered OR state that the tracking number delivered to an address different from yours (state you address)



When you get that letter and send it to eBay as part of an Item Not Received (INR) case or an appeal of a closed case then eBay will verify and  following the MBG to see to it that you are refunded.  
 
Seller is responsible for delivery to the address on your order and delivery to any other address means the seller didn't meet their obligation.  Problem is that the tracking system is automated and eBay Bots "sees" a delivery scan and assumes item was delivered.  So when that isn't the situation, the buyer has to provide the proof of misdelivery and file an appeal to the first "rejection" of the INR case.

 

Yeah, it is a bit of work and takes some firmness and "charm" to get shipping companies to memorialize in writing that they messed up.  But it can be done!

 

Follow those steps with your PayPal case!  You should be OK.

I've never even got a refund first off . I never even wanted a refund I wanted a replacement item .  sorry for being concerned about a package that I PAID for .

Take a deep breath.

 

If you think the package was stolen, file a police report and file with your homeowners insurance. 

Seller did his job. He is not going to simply refund because your package was stolen.  

Contact UPS (you may on hold for awhile trying to get to speak to a live person) and find out where delivered. 

It is possible it was misdelivered. It does happen. 

Sorry this happened...start making some phone calls and see if you can get your package.

You should have contacted UPS on the 24th when they say they delivered the package.

Cal UPS and find out where it was delivered and if it had your address on the package?

Why on earth would your neighbors cars be involved in this? Makes no sense. Not too many of my neighbors drive Porsche’s anyway. We are more Toyota and Nissan. Okay, one show-off has an Audi. Lol

WOW...you left the seller negative feedback because your package was either stolen or delivered to the wrong address?

 

Do the right thing and contact the seller and ask them to send you a feedback revision. 

They did their job.

The problem is the item has been delivered according to the tracking number

Good luck but i do not see you winning a case with eBay  as soon as they see item was delivered they will close the case

Proof of potential  delivery to the wrong address may be a possible if you can get exact address from UPS  I  would pursue that claim
