Hello there,
As you can see in the screenshot below, I went to "help" section then choose the item but no option called (not as described ) like before, I don`t know why eBay disable it.
My order was 24 oz but however, the seller had sent 40 oz!!! (I contacted seller, however , no response yet)
I am afraid that the seller will ask me to ship it back, then it will be an excuse for the seller to send wrong items then ask the buyer to send it back for refund!!! How many buyer will send it back? 50% ? no problem the seller still will have some profit)!
since eBay will not do anything to the seller, he will continue to do so for years!
That is why I prefer Amazon.

Just go to the Resolution Center and open a case for ITEM NOT AS DESCRIBED. Seller is responsible for return shipping.

eBay has folded the Not As Described option into the Return an Item for Refund. Once you select that, it works just like the old Not As Described claim did.

This click on the return for refund. Choose not as described for your reason to return. The seller will need to provide a return label for you to ship back

Since the seller sent the wrong item to you.
- The seller will not have profit if you return this item.
- Since the item received is different than what was advertised, the seller must pay for return shipping and refund the full product value plus any shipping you paid.
- Finally, the seller will receive a defect on his selling metrics because he sent the wrong item.
he will only get a DEFECT if ebay is asked to step in.
The return request will count towards his return rate but its not a defect.

My language error perhaps ... I don't know what we should call a ding on a seller's service metrics, but I was just calling it a defect. I realize that is the word that is used for the Seller Level defects.
Regardless, eBay is now counting all INADs against a seller, even if eBay is not asked to step in ... at least the one I had is now showing on my service metrics.

I really appreciate your great help guys.
But the question is still without any logical soulotion, I mean if the seller wants to circumvent on the rules of ebay he can do that easily.

what will I gain from this ? Unfortunately and absulutley nothing!

Seller sent you wrong item.
Yet, you do not want to return it? You want a refund.
Do you think Walmart would you a refund without you returning the wrong item?

I think that you are missing something as you have been given a very logical solution.
-Open a return,
-chose the reason for the return,
-the seller will have to pay for a return shipping label
-you send the item back
-the seller refunds you when tracking shows they have received the item back
You won’t have the item you ordered but you will have your money back. There is really no way for the seller to ‘get around’ that.

Now how can I make sure that the seller already has 24 oz bottle ? He has to ship it first, then I'll ship 40 back to him. Otherwise eBay will not know if he's trusted seller or not.

Just opening snad claims have service metrics against the sellers now. If the seller continues to have issues it will show. Also negatives show other buyers if the seller is a trusted seller. And lastly filing fully gets you your money's back. eBay has no way to get you you're right item or even be sure the seller has it that's impossible for them tp do but opening a snad does all the things youd want gets you fully reimbursed and gives a ding for there being a case opened Although at this point it may be too late if you haven't opened one yet

Does Wal-Mart reimburse you for your "wasted time" or gas, etc when you return something to the store (or from an online purchase)?

eBay is not a mind reader. They can't know beforehand whether or not a seller has an item actually in stock. But they do sanction sellers that make too many mistakes and have too many complaints from buyers.
The way to make sure that eBay knows there is a problem with a seller is by opening a return request for "Item not as described".
The seller has to pay return shipping. A return label will be issued for you to use.
You will get a full refund when the item is delivered back to the seller ... and the seller will get a ding on their service metrics.

Buy the correct size from someone else and just focus on getting your money back from this transaction. If I were I would buy them from a seller that was closer to you so that delivery is faster.
It it is frustrating when you wait for something and it is the wrong item but unfortunately mistakes do happen and all ebay can do now is to help you get your money back.
