Im not sure if this is the correct forum for this question so I apologize if not. I purchased an item with the assumption it would be shipped within the time frame the seller had posted, then I noticed after the purchase that the seller edited the listing and changed the date much later than I am willing to wait. My question is: do I have any recourse in this matter? Is the seller bound to the original date for shipping? Also is there a way to view the listing as it was at the time of purchase, because when I view the purchase details it does not show the shipping date as it was.

btw I am aware that shipping is delayed because of the holidays and tracking is wacked right now and I have no issues with that (yet) but I just wanted the item to be shipped on the date as advertised.

If you bought an item the seller has more for sale they can revise the listing. It applies to purchases from that date on. The seller can't change the terms of your purchase. The delivery date in your purchase history is when to expect it.

Fab is correct. All of my listings are continuous stock... always have more items to sell. So changing my handling time for purchases from here on out is no different than if I were to raise my price. It isn’t retroactive. And ebay doesn’t allow sellers to change ANYTHING on a previous sale record. So yes, the seller is bound to the original date of shipping AS LONG as you did complete the purchase before the change.
You mention that your shipping date is different from when you remembered it to be. There is a slight, and I mean slight, chance that eBay glitches are messing with you. But in my experience with this issue and previous buyers (I’ve dealt with this issue many times), they all usually end with the buyer realizing one way or another that the current ETA shown to the buyer was in fact the same one shown during their purchase.
Many things can cause this. Just off the top of my head 1) the most obvious, buyer recollection, 2) buyer didn’t put correct zip code when looking at the listing before purchasing, 3) item sat in the buyers cart for days and by the time they purchase either the seller changed handling time or the ETA increased by the time duration the item was in the cart.

Thank you for your replies. My record states: Estimated delivery Tue, Dec 29. and the seller still hasnt marked as "shipped" yet. If I dont receive the item by the 29th then that would be just cause to file a INR report, correct?

Have you messaged the seller and asked about shipment?

Under normal circumstances, yes. But as you mentioned in your Message 2, this is definitely not a normal circumstance. USPS is getting hammered and suffering massive delays due to Covid and the holidays, as well as going into this season significantly understaffed (thanks USPS PM General). They also have less workers since the ones still employed have been catching the virus too and unable to work.
This delay also affects tracking scans a great deal. I'd say well over half of my packages shipped out have inaccurate scans showing they are more inactive than they actually are. Postal employees have been skipping scans in order to save time since they prioritize the actual delivery of the package instead of it's displayed progress.
Many buyers have been patient and cutting sellers a break during this time since once dropped off to USPS, everything is out of sellers control. I'd say if your item isn't a life or death situation by having it arrive on 12/29, I would hold off on the INR... as that won't make the package move any faster. It'd be no different than if you file the INR at least one week later, you'll still be protected and get your money back or replacement.
I understand that you simply want the seller to ship on the date as advertised... and (s)he probably did. As the tracking (not only the shipping) is wacked. As someone already asked... did you contact the seller yet and voice your concern? If you didn't, the best we all can do is make assumptions.

While Im waiting for a reply from the seller I just want to also show you the issue Im seeing. I just noticed it when contacting them. When I clicked the "contact member" link, it brings up the item and order description so they know what item is in question. And it is showing the new "edited" estimated arrival date. Which as you can see gives me very little leg to stand on here. The only "proof" I have now is the "estimated delivery date" that shows on my purchased items list. Ill take a screen shot so you know what Im talking about, below.
Normally I wouldnt stress a week delay but of course this is a gift for someone that will be leaving on the 1st, and thats why I wanted the seller to adhere to the original delivery date.

That Jan date is based on if you bought that item today. Is that screen shot showing the 29th in your purchase history? The day after that is when you would be able to open a claim.

It may have already shipping just not marked as shipped. Parcel Select is slow and Priority is usually given well priority. Also once it is marked as shipped and has a tracking number it won't necessarily be scanned by the Post Office until it's delivered; it may not be scanned as often as in the past pre-covid days.

Your stressing is valid. Just know that everyone else involved is also just as stressed during this unprecedented time. Good luck to you and your package.

I have shipped item that have not gotten a scan in over 2 weeks. I am fortunate that my local office/carriers are very good about scanning, or these items could appear as they had never been shipped.
Your seller may, or may not have shipped.
Being aware of the carrier delays, I gave up on trying to sell early in the month. I also have no expectations of items arriving in a timely manner. I am ordering nothing that is time sensitive. It would be unrealistic at this time.
Not sure how your item is traveling, but USPS is buried at this time with some locations sporting truckloads of packages just sitting waiting their turn.
Everyone's expectations should be lowered at this time. The estimated delivery dates, are many times, not based on what is happening at this time.
My last 2 FedEx deliveries came in late.

Yes the 29th shows in my purchase history. Date of purchase and cleared payment was on the 13th.

Thank you for the replies, and yes Im very aware of shipping delays and non-scanned items. Still no response from the seller which makes me feel wary and now brings up the next question. What is the latest that someone can cancel an order? In the eBay terms they mention cancelling within an hour and after an hour only, so does that mean as long as they havent shipped it yet, it can be cancelled?
12-23-2020 08:11 AM
No cant be cancelled by you / buyer at this point. You can try another message and ask for a refund if it has not been sent yet. Or simply file the INR. Its hard to say what is going on with no response from seller and no tracking.
What kind of seller they are based on feedback, quantity of items, years selling, etc can all be considered but in the end if you no longer want the item because of needed for a gift say that in a message. If you finally receive it, open a case for not as described since not shipped as described in listing and return it.
