seller says he received a damaged item from ups shipping

i sold a electric bike battery with ups on ebay for someone in brooklyn sept. 6th

then on the 7th, the seller claims: "I saw the ups guy today and he showed me the box and it had a whole in and nothing inside. What do we do about my money?"

i check the tracking number on both ebay and ups to see it's documented that the box i shipped the battery in was damaged...but the package never claimed to be delivered or even claimed to attempt delivery.

i then spoke to the seller about sorting out a claim to get his money back asap and asked him for images of the box but he says he doesn't have images of the package.

so it leads me to assume the package hasn't been delivered since he doesn't have images of the box.

now on sept 9th roles around and the tracking updates with the package going out for delivery—mind you after they claimed the package was damaged—and he gives me the same story, this time, it looks like the buyer refused the delivery claiming: "The receiver states the product was not ordered and has refused the delivery."

then the buyer proceeds to message me: "Ok so now the ups guy comes to my house and ask me do I have something for a pickup. At this point I just want my money back."

on the 8th i decided to file a claim with ups without any images of damage to the box, and i'm waiting for them to reach out for god knows how long.

i'm not sure what to do. i never got an email about the package being damaged from ups or ebay. i found out something was wrong via the tracking number and the buyer. he claims the box is empty, but it was never delivered because he refused to accept the delivery.

The buyer screwed up when they refused the package, because they lost their MBG.

I would wait to see if the package is returned before doing anything else.

If the buyer files an INR, respond to the case and upload the tracking number.

ebay favored the buyer. don't know what to do. i do not have my item and i cannot shell out $300 and make it go into thin air.

Definitely something shady going on with this buyer. He wanted something for free. As far as I know UPS doesn't show you a package days before they attempt delivery.

For something that expensive I might have insured it. And if it was damaged your claim with UPS should give you your money back.

I'm not sure what else to suggest if you had no insurance. A lawyer?
