I ordered a 1080 ti described as new. it came used and opened. i took pictures from out of the box. Contacted them directly by phone and they are trying to email me a return label instead of going threw ebay. My assumtion is to get the item back and say i didnt return it so they can resell it. The lady on the phone said hold for a miniute and i heard them talking about insurance or something on the item i couldnt quite hear. Please be warned about the seller. They are scammers. Now im playing the waiting game to see if ebay will step in. Last part i need for my pc build to now i have to wait weeks on end for a response. Hopefully i get my money back we will see i guess.

Go to the Resolution Center (bottom of page) and select: I received an item that does not match the seller's description.
Seller should send a prepaid return shipping label and refund you when they get the item back.

Yes i called them and tried. they tried to send me a return label threw my email and not ebay. I contacted ebay and the seller directly. If i send the item back im sure they will still refuse to give me a refund. They are scammers. How they operate.

File a SNAD complaint with eBay.

You assume too much. As long as you have a tracking number and the emails you can prove the return. Just to add a little more protection and/or to make you feel a bit better, outline what you are doing and note the tracking number and where you got the return label in an email to the seller inside of Ebay. Then Ebay has the info too.
However with that said, if you are still uncomfortable, just open a Request for Return in Ebay. Ignore the label the seller has sent you or just wait to use it until after you open the Request. But know it is not unusual or a bad sign of any kind that your seller is working with you to resolve a matter.
Some of my customers I work with and there is never a Request for returned filed and some there are. Either way, my service and attention to the matter is the same with or without the Request for return being filed.

You really need to keep all the communication with them inside of a Significantly Not As Described (SNAD) case on eBay. Don't use their label from email, I repeat, DO NOT USE the email label, when you file the case you will be provided with a label to use thru eBay. You are giving them the opportunity to scam you unless you go thru the appropriate eBay channels. Did eBay tell you to file a case? If not, file a case.

The communications being kept inside the Request that the OP may open is solid advice. At the very least, keep your communication inside of Ebay.
However the shipping label is a little different. If the OP chooses to file a Request for Return, then an email goes to the seller. The seller then has the opportunity to decide if they are going to provide the label or if they are going to just have Ebay issue the label at the seller's expense. Either way is fine. Just make sure the tracking number gets logged into the Request for Return if the seller's label is used.
Tracking is the key. Not whether or not a Request for Return is opened. Along with communications inside the Ebay system M2M [member to member].

Here's the problem with using the label the seller may email you outside of the resolution center. Buyers unfamiliar with the process may not file a return at all and let the seller string them along past the 30 day limit to open a case.
Or, if they do open a return request after getting the emailed label, they oftentimes do not know to enter the tracking number in the case or enter it wrong, not follow up, any number of pitfalls. It's just easier and more secure to do it through the resolution center.

I've sent many labels to customers over the years because typically I will pay less for the shipping that what Ebay wants to charge me if I let them issue the label. And I assure you I have NEVER taken advantage of any of my customers and/or short changed them on anything.
And it this was a problem, why would Ebay give the sellers the option to issue their own label? Ebay is big on protecting buyers as we all know. If Ebay were to be seeing some trend of sellers that issue their own labels taking advantage of their buyers, that option would be gone in a heart beat.

I'm not saying that this particular seller is. I'm also not saying that they aren't.
It CAN happen, just like it does when unscrupulous buyers talk sellers into using their own (the buyer's) label.
It is something to be aware of.
