I have someone trying to return an item 40 days later, after using it several times, he is claming it is defective after using it for more than a month. Can i decline that return?

This is eBay's return timeline policy:
A buyer must request a return no later than 30 days after the actual (or latest estimated) delivery date, or, if the seller's return window is longer, within the return window.
Since you do not accept returns it is within 30 days of the actual delivery.

I forgot to mention that even if it is past the deadline eBay still allows the buyer to open a claim to see if they can work it out with the seller. But the buyer cannot escalate the case or ask eBay to step in if the 30 day period has expired. However, eBay always encourages sellers to create a good buyer experience. Why is the buyer claiming the item is defective now?
