is eBay or PayPal better to file for a promised partial refund?

Not sure if this is the right forum for this question, but here goes -

I recently bought an expensive pair of diamond earrings.

They were sent in a plain priority envelope in a single cloth wrapper.

One of the lever back earrings was bent and on the other earring, looking with a loupe

I saw a crack in the silver.

I took the earrings to a jewelry repair shop and got an estimate of $18 to fix the crack (dangle could fall off) and 62 to replace the lever backs.

I told this to the seller who said he was very sorry and would make it right.

After a week he offered $50, then$60.  I said okay, even though it will cost me more.  I like the earrings as they are very similar to a pair I lost and wanted to get them fixed so I could wear them.

Two weeks later still no refund.

I was talking to Paypal about another issue and asked them about getting a promised refund and they said absolutely after 30 days I could contact them.  Before that I should talk to Ebay.

I am close to 30 days and wonder if Ebay or Paypal would be more effective?

Neither...imo

 

File SNAD & return for full refund.

 

I NEVER offer or expect partial refunds.

Neither will compel a partial refund,seller has to provide that on his own.Even if you have a case w either and seller offers a partial but does not send it when ebay or pp step in they will tell you to return for refund.Seller is stringing you along so you lose ebay protection(maybe hoping you don't know about pp)

And you (the OP) need to act fast because you WILL end up returning the item because the seller isn't going to send you squat.  If you return it via eBay, the item gets returned on the seller's dime.  If you lose eBay's MBG and have to go through Paypal, YOU get to pay return shipping.

 

Return the item and go find yourself a nice pair of earrings and avoid all this drama.

You have 30 days from delivery date to return the item and FB is irrelevant.  When was the item delivered.

I just spoke to Ebay and they said what you all have said - cannot compel a partial refund, only a full refund and I have 30 days.  I frankly do not think that the seller has any money to do a refund with, but Ebay said they would be responsible - right?  I just sent the seller a message saying he has until Sat to do the partial refund or I will have to ask for the full refund and return the item.

Do not worry about the seller not having the money. EBay has a very good system in place to get the money.

 

Again, what was the delivery date? You only have 30 days past that date to open a return with eBay and have the seller pay the postage. After that, you would have to go through PayPal and pay the postage with tracking yourself.

Why make this so difficult with all the back & forth messages? 

 

File the SNAD & ask eBay to step in when the option becomes available. 

 

The seller is giving you rope & you may use it incorrectly.

Reply from seller - will do the refund by Sat p.m when his plane returns - assuming it does not crash -he said.

Do you think it is a problem to do a refund if you are in Mexico?  If he is in Mexico.......

If he can answer your email, he can do a refund. 

 

What exactly is so special about this pair of earrings?  Do yourself a favor and just return them.  Why all the drama?

 

I have to be honest and say that you are just reaffirming my attitude that if it is good enough to keep, it is good enough to pay full price for.  You seem to think these earrings are extra special enough that you don't want to return them.  Well then keep them and stop asking for a partial refund.

 

Return or keep.

I agree 100%. Just file the case.  Best case scenario the seller gets back and issues you your partial, worst case, you return for a full refund.

 

Also, the seller may now have grounds to get any negative feedback removed by you saying "  I just sent the seller a message saying he has until Sat to do the partial refund or I will have to ask for the full refund and return the item. " under the feedback extortion rules.
