Your text confuses me a little ... but ...
The Global Shipping Program inspects packages as they arrive, and if it were broken upon arrival then they would not have continued shipping it to the overseas customer.
You should not have an action here, because this refund should be handled by the GSP.

Contact ebay by email from the help pages or through Facebook or twitter. Just explain that it was global shipping damage so the gsp is responsible for refunding.

@orangehound I know that you use the gsp so have you had a buyer puts in a claim for lost gsp item or damaged item and if so, how have you handled it? I know that the system is supposed to recognize that it was a gsp transaction but I've read stories of where they didn't seem to take that into account so the refund was taken from the seller. I would think that if a nad claim is placed, the seller would have to contact ebay to explain the situation as ebay wouldn't know how the damage actually happened of if it is a seller related problem.

Remarkably, I've only had one GSP claim in my entire history with them (maybe 250 shipments), so I speak much more from what eBay employees say than experience. That one claim was on a $2 part off of a $300 item, and because I showed the $300 item for reference, he thought he was getting the entire $300 item for $2 ... even though the title and description were clear it was for a part AND the buyer had to select the part from a drop down menu. You can't fix stupid. I don't fight small potatoes, so I refunded the $2 + $2 S&H, reported the buyer for low IQ, and moved on.
By the way, one of the most informative posts from an eBay employee regarding the GSP can be found here:
