On the Item Not Received claim, did you "ask eBay to step in"?   You have this option after a few days of opening up the INR claim.

You need to Escalate your request now for ebay to step in & make their determination.

You will never be able to ask eBay to step in. You started your request too late, more than 30 days past the last estimated delivery date.

Although eBay still allowed you to start an Item Not Received request 3 weeks ago, you're just having a (one-way) conversation with your seller. eBay is no longer able to get involved.

Instead, if you paid with PayPal, open an Item Not Received dispute, and escalate your dispute right away to a PayPal claim. Do not respond if your seller contacts you now; just wait for your refund. http://www.paypal.com/disputes

Or if you directly paid with a credit card at Checkout, call your card issuer and file a chargeback.
