eBay’s Money Back Guarantee is USELESS. Paypal’s resolution center is WORK!

This is a “empty parcel received” case. I bought a Rolex dial that was EUR1950 from an Italian seller. The payment was made by Paypal. After the seller denied refund and responsibility, I put the case to the ebay’s resolution center. ebay requested me to submit police report included the following information within 10 calendar days.

 

Description of the item
Name of the officer filing the report
Badge number of the officer filing the report
Incident report number
Station location (city and state)
Station phone number

 

Meanwhile, I found a recent ebay’s feedback of the seller, another buyer (buyer ID: i**p) also complaint that he has never received the watch. Our cases also involved a big amount of money.

 

I followed this instruction and report the scam to ebay but it finally decided I won't receive a refund without any explanation. I applied an appeal immediately, ebay took three hours to rejected may appeal and kept the original outcome. Again, ebay did not give any explanation for its decision.

 

After a failure of ebay, I reported the case to Paypal by using same information. I also called to its customer hotline and explain my situation. Its staff was very helpful and great listener.

 

I finally have my refund from Paypal. This is a golden rule of dispute to ebay’s buyer.

1.Request an insured shipment from seller
2.Make a payment using paypal
3.Make a video when the courier deliver the parcel
4.Check the envelope open sticker before open it, make video and pictures.
5.If there is a “empty parcel received” or “sands received”, go to police station for incident report, request a copy of incident report after the reporting.
6.Check the negative feedback of seller
7.Open a case to ebay and paypal, submit all information for their investigation.
8.Try to call their customer hotline, especially paypal.
9.Paypal is more importation than ebay, ebay’s Money Back Guarantee is useless.

eBay's Money back Guarantee actually works very well for those who read and follow the term of the policy.  eBay denied your claim probably because you filed an Item Not Received dispute, instead of an Item Not As Described dispute.  An Item Not Received dispute is automatically decided in a seller's favor if there is door to door tracking that shows a package was delivered. It cannot tell if what was in the package is the item that was ordered or not.   An Item Not As Described dispute does I believe have an option to select I received an empty package, or the number of items that was ordered was not the number received.

There are several things wrong with the list you posted, and you cannot post a member's username accusing them of something on these boards.

Insurance is for the seller's protection not a buyer's. It only protects an item from shipping damage, not theft or receipt of an empty package.  If an item is sold for more than $750 the seller is supposed to insure the package at their cost.

  That is pretty much the only method most payments can be made on ebay.

A video or photos of a package being opened may not be accepted by ebay or PayPal as proof of what a package contained. An international shipment may show signs of being opened by customs agents.

 The best way to get proof of an empty package being delivered is to open the package in front of the carrier, before signing for it.  Often using the tracking number you can schedule delivery for a date and time when you will be at home to receive it.

 

5.If there is a “empty parcel received” or “sands received”, go to police station for incident report, request a copy of incident report after the reporting.

A police report is not always needed. If you can contact the shipping service and get the shipping information about the package's size and weight. Then compare that information to what was received. If the box with an item and packaging should weigh over 1 lb. but the one you receive weighs less than that. Getting proof from the shipper will help win a dispute. 

  As for going to the police, if they did not witness the opening of a package, their report, is not much proof of anything.  It is only your statement that they will report, which is not proof of what happened.  In an international transaction a police report is probably useless.

 

6.Check the negative feedback of seller

  That is something that should be done before buying anything from any seller. It should have been the number one thing on your list. 

 

7. Open a case to ebay and paypal, submit all information for their investigation".

  You can only open one dispute at a time, and ebay is who you should start with.  If you open disputes with both companies at the same time, both may be closed in a seller's favor.  The last option would be to file a charge back with your credit card provider, if you pay with one, by calling the number on the back of the card.
