No need to sue 😞

Some sellers don't use tracking. It may just show up without a tracking number.

(And sellers are not required to use a tracked service)

If it doesn't show up ... File an Item Not Received claim  after the estimated delivery date has passed.

You have 30 days from the Last Estimated Delivery Date for file a claim.

EBay does not require sellers to reply  to buyer communications.

Hopefully your package will soon arrive.

If your item does fail to arrive, you may open an item not received request, the day following your last estimated date for delivery.
