bought a item from a seller (a cell phone)

hi all - I recently bought a cell phone from a seller - paid over $200 - but what i got is an ripped open package on my front porch from FedEx.  Tried to open a case with Fedex - they said the seller is supposed to do that so they closed it.  then tried to open a case with eBay - & they got with the seller & he said he shipped it & had the tracking number - I NEED SOME HELP!  What should i do?  Am I out the $200?

Your probably going to have to go to your payment source. Hopefully you used a credit card or PayPal. If you do open a dispute with PayPal, use Missing Parts or something similar. Don't use Not Received.

With FedEx, since eBay is the account holder, only they can deal with them, and they don't seem to want to bother with it.

On eBay @ryannbri after you lose an "Item Not Received" case because tracking shows Delivered, you can go back and open a second case, a return request for "Missing parts or pieces" as the package arrived without the item inside.

After 3 business days, if you didn't get a refund or a prepaid return label, come back to click Ask eBay to step in. Either way, if you get a return label send the ripped-open package back, enclosed inside another box or envelope with that label affixed, to get your refund.
