Hey trinton@ebay,
Here is another of those cases where you are going to tell me I should take one for the team, even though I included a picture of the turned on screen in my listing, and you can see some ghosting he did not seem to be concerned as he never asked.
Had a 3 year old piece of electronics that I sold, original buyer never completed the transaction, I offer a second chance to the next bidder, he asks a couple questions, scratches, damages, including why the item was not sold. Answered every question, there were pictures in the listing or the item as well as many extra accessories that I included at no charge, actually the accessories are valued more than the item at this point. He seemed fine and told me he would take it, made the payment and within 18 hours of payment it was in the mail, and the post office got it cross country and delivered in less than 48 hours, so total time from payment to at the destination 62 hours.
He gets the item and messages me saying the is a problem with the screen (picture of screen in listing) and he wants my help. The issue is there is a bit of screen ghosting on a 3 year old phone, bright screen is in the picture on the listing. In my photo you can see some faint shadows, he claims severe burn in, well after 3 years some ghosting is expected. We go back and forth, he wants me to pay to have a new screen put in, I have it listed as used, and no return/exchange. During the back and forth he mentions that if he know there was screen burn in he would not have bid as high. Needless to say we did not come to a resolution.
I did a quick search and the price he paid is the agerage for a parts only phone, and those that are functional are more then this guy paid, and they don't include 3 extra batteries, on a hicap, a case a charger for the smaller batteries, I even sent the replacement nibs for the spen. I also reviewed a lot of listings for the note 4 as well as other large smart phones from that tims, not one had a listing that medtioned anything about screen burnin, most used the catalog listing and not much else.
So he opens up SNAD and I am ticked because I listed as used, took a close up of the screen turned on with the welcome screen showing, which is white and you can see slight ghosting. He never asked about it. So now I have to wait until Thursday the 24th to be able to do anything because I get 3 days to respond, but oh buyers get months to do things it seems.
So I guess that I will wait until the 24th and close my account because I can find a lot more places that I can shop, and as I don't sell much is it really worth it?????
Not sure if this has been suggested, but make it an effort to file a SNAD claim, make to buyer bring the packaging and item to a designated location for inspection, inspector looks at it, looks at the listing, make a decision, if its the same, ebay should say sorry but that is buyers remorse. Or because Ebay offers the MBG, then EBAY pays it, why because the seller did it right and the buyer regretted their decision
Ass I wait for the 25th when I can close my account because some off shore call center staff made the whole thing worse that it was, trinton were you working evenings on 19 Aug.
Just a couple more days then poof

@emtp117 wrote:you know that is not what I meant, you keep saying flaw and it is not it is wear and tear and before you make an assumption as you are repatedly look it up and you will see it is wear and tear and not a flaw. And I disagree it is up to the buyer to ask questions, if you go into a thrift or second hand store and see something are you going to buy it without asking a question, somehow I think not.
@angelgirl327if you are going to keep accusing me of concealing a flaw as you are just keep it to yourself. I have looked at it since this happened and it is wear and tear and maybe you should do your due diligence before making unfounded accustions
The problem is you're coming at it from the way you think it should be and we're coming at it from ebay's rules. Since you're on ebay, it won't be the way you want it to be. Sorry - tell them to return for refund and send them a label. This is one you will never win. If you hate the way it is then you may not be cut out to sell on ebay.
If you want to be protected then you have to list every single thing about the item and show lots of pictures. It doesn't matter what you call it - flaw or wear and tear. You keep thinking it's up to the buyer to know things or research, etc. That's not ebay's way.

Regardless of whether you think it's normal wear and tear or not, based on the replies here, as well as the fact that your buyer wants to return it, you should be able to tell that the general public is not aware of it, therefore it should've been disclosed. Either take it as a learning experience or keep hoping that your buyers ask the "right" questions in the future.

thinking that it is a flaw that was brought about by wear & tear plus age......simply listing something as used is just not good enough any more on ebay. the more detailed your discription the less problems that you will encounter further down the road. when you think that you have explained every small, little detail about your item, go back & explain more. then do it again. you cannot give the buyer any reason to file a claim against you & when it does happen, handle it professionally and offer a return for refund. its not the end of the world nor is it worth the stress of getting upset over it....lifes' too short, you will make it up on the next one. just my opinion, no disrespect intended.

OK, First things first. You can't sell something "Used" with No Returns/No Refunds/AS-IS (or whatever else you want to call it), nor can you sell something "New' or "New - Other" with this restriction either. If you really want to sell it and MAYBE keep your money and MAYBE have the buyer keep the item you have to sell it "Parts or Reapir Only". That is the ONLY safe condition that will most likely (not always) enforce your no return policy.
EBay's MBG trumps ANY return policy you have, even Parts or Repair Only however, you have about an 80-90% chance you can win a SNAD claim with that condition. I suggest you read the eBay MBG and see what it says. I also suggest you read a post I made about a year ago in Nov 2016 (on this id) about SNAD claims and read how eBay thinks and applies polices. Simply click on my name and search for "SNAD" (do not include the quotes) and pick the 2nd post down (the 1st post is a good read too).
As far as you waiting until the 24th, you're wrong again. You MUST resolve the SNAD by the 24th, not wait and see what happens. If you think your going to ask eBay to "Step In" (aka "Help you"), that is the biggest mistake you can make.
At the point, I suggest you accept the return and send a return shipping label. There is not much can can do at this point.

I read your post, and it is appaling the way ebay treats people. See the problem is that no matter what you do ebay undermines you. Maybe ebay should just do away with all condition listings and make everything a free for all, go ahead and accept it. I will have my account closed very soon, ebay cannot keep it open once the fees are paid and they screw me over for the refund. once that is done I am done.
I have no intention of doing anything more on this thread it has gotten out of hand.

@emtp117 wrote:...I have already said, I am done. If you want to be taken advantage of who am I to stop you.
You're not done unless you have resolved that case. If you don't, on the 3rd day the buyer will ask eBay to "Step In" (or worse yet, you will make that mistake) and eBay will find for the buyer, let him keep the phone and force a refund of the money (and you'll have a defect to boot).
You realize that the buyer could also open a SNAD claim in PayPal for 180 days, don't you? You also understand that if that buyer used a credit card (which I strongly recommend all buyers do), they can open a SNAD case for a year or more in many cases, don't you?
If the buyer started at the credit card level, you will be getting a $20 charge for the chargeback from PayPal AND you would STILL have to pay return shipping for the phone and refund.
At least now, you can resell it "Parts or Repair Only", or if you're really done you can sell it on CL for cash and be done with it.
Good Luck

As long as you have the attitude you have that you didn't do anything wrong and everybody else is wrong and screwing you, blah - blah - blah, you will never be able to sell anywhere else. Because they all have rules to protect people. You're not seeing any of this the right way and what we are saying is actually to help you. Selling on ebay can be great - if you do it correctly.

I guess just sellers just have to learn things the hard way 😕
you guys provided so much invaluable advice and it went in one ear and out the other.

Hey @emtp117, I know that facing a return when you believe you described the item accurately can be a frustrating situation at times. I can recommend that you look at the buyer's report and compare it to your listing description to determine if a return is in order - if there is any reason whatsoever to believe the listing did not prepare the buyer for the condition of the item they received, a return should be accepted for a full refund. Based on the conversation here in this thread, it appears as if the listing could have been clearer by outlining the defect as well highlighting it more prominently in photos. Additionally, an item listed as Used is fully functional, but may have some minor cosmetic wear and tear. Damage to the display of the screen from age could be considered as not fully functional depending on the severity. All in all, while I know this may not have been the answer you were hoping for, I believe accepting this return is your best course of action moving forward.

Good Day.
