If a buyer opens up a case requesting a refund but it is due to a package being lost by USPS, will I get a defect if they do not escalate within 30 days and the case just closes without resolution? I called USPS and they are investigating. I have tried contacting the buyer(through the ebay case messages) and they have not responded to my last three updates, for about two weeks now.

It is not 30 days, it is 3 business days.
Refund the buyer within these 3 days, is the safest. Calling eBay and ask advice, is risky.
Refund, and ask the buyer to pay again if the item shows up. You can send a new invoice too.

Three days? I think I had three days to respond once case was opened, but 30 days before case auto closes unless buyer escalates. It is still under investigation so why should I refund now and trust buyer will pay me back if it shows up? If they don't care enough to respond anymore(it was an inexpensive item) and don't bother escalating, will I receive a defect if it auto closes?

Please don't ask eBay to step in. That is risky. Unless you can prove that the item was delivered.

These 30 days. Do you want to take the risk that the buyer won't ask eBay to step in within these 30 days?

Well the thing is, it is an item only worth about $10 and the buyer is not even bothering to respond to my question of "did the package ever show up to your box". I have been on the phone too long and too much trying to find info for them. I even talked to their local USPS a couple times and their postmaster asked me to contact them to see if it showed up. I am at the point where if it is not bothering them if they got it or not(hell, they may have got it and just don't want to say) then it doesn't bother me. The one thing I need to know is if it auto closes and they haven't escalated, will I get a defect?

Ok so not defect. I wasn't sure because I thought I read somewhere where it would result in a defect but it wasn't clear whether or not that was the outcome. And I am assuming there will be not auto refund as well, right?

A request automatically closes without defect and without refund in 21 business days, not the eMBG's previous 30 calendar days, after it was started if the request is not escalated to a case.

simply give the refund to the buyer and be safe from negative feedback and after refund leave message to him that you tried contacted him but got no response, you already did your part and tried contacted him but he is not responding even if he leave negative feedback you are safe, now the item is lost by USPS , file the claim with USPS but i guess you cant file claim if less than 15$ amount on their website, than call USPS. once the buyer will get refund in time, what he can do is to leave you negative feedback but you will win the case because tracking and your communication with buyer is evidence to save yourself.
TIP : any item is less than 10$ mostly it fall under first class service, so always use CLICK N CHIP BUSINESS PRO its offer first class shipping , so if package lost you can file claim with low price items.if you use ebay system for low price items than i don't think so USPS will let you file claim.
