Will I win if I ask ebay to step in?

A buyer gave me a shipping address that was missing a unit number (postage software warned me). I also checked on google and the address looks like a 4 unit building.

 

So I messaged the buyer about this and asked for the unit number and complete address to prevent the package from getting lost in the mail or returning back to me. The buyer replied to me (in ebay messages) with the exact same address (without the unit number) and told me to send it. So I reluctantly did.

 

It's been two weeks and the buyer filed an INR complaining that he didn't get the package yet. I see tracking that in one of the scans it says "Insufficient address". It's supposed to be returning to me, but never made it back. So it's clear that the mail carrier didn't deliver it because he didn't know what unit number (something I WARNED the buyer about).

 

If ebay is asked to step in (by either party), will I win or lose this case?

If you added the tracking number to the listing when you shipped, You can reply to the dispute in the Resolution Center console stating tracking showed "undeliverable due to Insufficient Address".  That should be enough to get the dispute closed.  In the comments section you should add that the buyer was notified of the incomplete address in an ebay message.

 

It is possible the P.O. in the buyer's city still has the package and the buyer can go pick it up.  They should either print out the ebay transaction showing the tracking number or possibly bring their phone or tablet.  They'll also need a photo ID with the correct street address, and the P.O. may turn it over to them.   Ask them to call their local P.O. and ask if the package is still there.

 

If the item is being returned, tracking will not show that, and it will be returned using standard shipping.  Once it is returned You should refund the purchase price only minus the 2.9% + .30 cent PayPal fee.  The buyer is not entitled to the postage refund and the fees you will lose, since PayPal does not refund the fees they charge you.

Yes

As long as you shipped to the address in eBay you are protected. If you changed the address you wouldn't be. Upload the tracking number into the dispute. 

 

I had a package the buyer never picked up from the post office. I asked eBay to step in and they found in my favor.  I eventually got the item back and decided to refund him minus shipping and fees BUT that was my choice. 

 

You shipped it and it arrived where the buyer told you to send it. Your part is done. I'd ask eBay to step in however I also have an impeccable record with eBay so that helps.
