Its UPS again, and now the seller.
In a nutshell UPS failed to deliver an item..a safe.
I then started a returns process, the seller and I agreed that UPS should return it to him.
We both messaged them and I got an email from UPS saying they would do this.
So they attempt to deliver to me..again !!
I have never actually had the item, but now I seem to be stuck in the returns procedure.
Yes I have informed the seller, he has not replied to my previous 2 emails.
So, I have paid for the item, I have never had it, a number of messages to the seller and UPS have got me nowhere ( no refund ), and I don't have it to return , UPS have it.
Ebay procedures do not allow me to proceed any further it seems, yes, I have tried !!
So what next ? no it won't let me go to "resolution", I cant return what I don't have and UPS are just awful, the number of failed promises I have had from them is ludicrous, the seller doesn't seem interested any more
So, what next ??
Please read above carefully, I have tried many ways to resolve this already !

Well, it would seem that if UPS can not or will not deliver the item (did they give you a reason? - a safe may be too heavy for example, there is weight limit) then they will return it to the seller as "undeliverable". That you opened a returns process does not affect what UPS does.
That being the case then there really is nothing for you to do until UPS gets it back to them. If the seller does not issue a refund you could escalate the case with eBay and/or file an "item not received" claim with Paypal (or whatever method you used to pay in the first place).
Parenthetically, since you never received it filing a "return" was the wrong step. You should have filed an Item Not Received case.
