What if my returned item doesn't arrive?

I bought a used item that didn't match the listing when I got it.  After a tense back-and-forth, the seller agreed to accept the return. I used ebay's return label to mail it USPS, but it hasn't gotten back to the seller yet. It's been in between postal centers for over 10 days with no updates.  If it never arrives, can I still get a refund? How long would I have to wait? Would the refund come from ebay or from the seller?

Tired but from this topic:

1. If a buyer returns an item, provides tracking, and the item hasn't been delivered within 5 business days, either the buyer or seller can ask us to step in at that point. If tracking shows movement within the last 7 days, we'll place the case on hold for 5 days for a domestic case or 10 days for an international case to allow more time for the package to be delivered. Tracking is reviewed before any decision is made. If the buyer paid for return shipping then we would close the case in the sellers favor.

2. If the seller paid for return shipping then it would close in the buyers favor.
