Vintage Lamp Arrived Broken

My fiance bought a vintage oil lamp for $11.00 plus $24.99 shipping = Total $35.99. He contacted the seller and provided photos. The lamp was in a very flimsy box, not large enough for it, and only wrapped with a little bit of small bubble wrap, no other protection. Seller has a no return policy but wants him to return the package and he will file the claim. However, that will means my fiance is out $24.99 for the return shipping. How is that fair? It isn't his fault. The seller did not package it correctly to begin with! What options do we have here?

That is absolutely not how it works; don't listen to the seller.

 

Your fiance should file a claim in eBay's Resolution Center for item  not as described, and should not communicate with the seller any more.  If the seller wants the broken lamp back, he can pay for the return shipping himself.

 

Here is eBay's buyer protection policy, which they call the "Money back guarantee."

Go to the resolution center at the bottom of the page and choose, the item doesn't match the description.

The seller will have 4 days to provide return shipping or give your refund.

If they don't, on the 5th day, go back to the case and ask Ebay to step in.

It sounds like with the photos your fiancé provided, the seller has enough information to file a claim with the USPS. There's no way you should be expected to ship the item back to them at your expense. If they want the broken lamp back, they should pay for the shipping. You'll be refunded regardless.
