I am a seller and send plenty of packages out per week. I sent one out and the customer claimed she/he didn't recieve the package. USPS tracking one day claimed package undeliverable to said address but the next day, claims delivered. The postal service did a check and followed the package to the wrong address approx ten miles away. Same zip code and looks like same general area but the client does not want to take out a claim. I offered to send them all the information I have but they want me to do all the work. I live in Texas, they live in Cali. My local office said they need to file the claim since their office made the mistake. The client either wants me to get the item to them or give a refund. I don't understand how I can give a refund for an item delivered regardless of wether the address is right or wrong since it wasn't my fault. HELP. Thank you. M.

From what I understand of what you described so far:
1) Your beef is with the USPS not with the buyer, so don't make it with the buyer
2) You shipped the package so it's your responsibility to have placed it in "good hands".
It sounds like everybody can come out a "winner" here, no? If not, please elaborate further.

I'm not blaming the buyer. The USPS messed up. I feel like the buyer could do their part and check with their office. Am I at fault and liable for the loss of this item? I did everything right including address Ect. I want to know what I am supposed to do. How many items can the USPS loose and we the sellers have to pay for?

My local office said they need to file the claim since their office made the mistake.
That's baloney from a lazy or incompetent worker. Either party can file the claim, and it is in fact easier for the seller to do so. You can do it online if your PO doesn't cooperate.

You are technically liable, but could weasel out of an eBay claim if tracking shows delivery to your buyer's ZIP. There is no reason for you not to file the insurance claim; you would need to provide the post office with insurance/shipping information anyway. Also, you should file the insurance claim with yourself as the beneficiary, and refund the buyer yourself if it comes to that. Fairly often, the package finds its way to the buyer while the claim is being investigated.

You are not liable for the item, If tracking says delivered, then you have completed your part of the transaction in eBay's eyes.
However, it would be nice for you to assist the buyer in locating her item.

Maybe. The USPS is basically your agent. Certain the buyer didn't mess up. Would definitaly be nice if they checked, but, since they said no, I guess their premise is that they're still waiting for the package. Since that's the case, I can only assume they're still waiting for the package, or a refund. If it's a one of a kind, then somehow it need to be gotten from where it was sent, or, a refund. If it's not one of a kind, send another. In the meantime, since you mentioned a claim, sounds as if you have insurance, so, file it. That way everybody wins.

HUH? YOU are responsible for the delivery of your packages. The buyer is not. This is a basic Ebay rule. On the other hand , the PO is responsible to YOU. Now this could get messy---beause the PO did deliver your item to the SAME Z IP CODE----in which the buyer lives.
So you will have to make sure that that particular PO---gets the correct detailed name and addess from you---so that they can see precisely what mistake they made.I don'tknow what you areplanning to do forthe buyer in the meantime. But don'tget him so mad that the hits you with a Negative!l Remember---the buyer did nothing wrong.

Our office contacted their office and the Superviser is suppose to let me know what they intend to do. The package was not insured. The paper work detailing their wrong delivery is in my hands which I offered to the buyer so they could help with retrieving this item. I know most good folks would do a return to sender but until I talk to the USPS today, I have no idea what is next. I will file the claim and try to get everything right with the buyer. I am sorry the USPS lost the item. All I asked from the buyer was a little help since the item was delivered to the same zip code. I will do what I need to do to get this right. I checked on Friday and the office called derictly to their office. I cross my fingers they got the item and it is being sent to the right address. I know I would be upset as well.

As they know where it ended up getting delivered, the two main aspects at the moment seem to be:
1) the cooperation between the two POs
2) the receipient is willing to fork over the package and its full contents in a saleable state.
If (2) is a no-go, (1) does not seem to matter. So, how are they approaching (2)? Putting a sticky note on (2)s door would be silly.
Insist they resolve this today, as with stuff like this, time is of the essence and it's already been a bunch of days.

I wouldn't say that the package is "lost" in the usual sense of the word, since everyone seems to know where it was delivered (i.e. the wrong location where it's at right now). I would hope that since it's plain to the current recipient that it's not his package (as it obviously does not have his name on it and apparently does not have his address either), he would be expecting his carrier to come by and pick it up, if he's not able to simply take it back to his post office. Maybe he left it out in front of his place and is waiting for it to magically disappear.
Someone needs to light a fire under the recipient's post office to get them to go out and get the package back, since they're apparently already able to figure out what they did with it, and where it is now.

I agree. Probably technically it is illegal for the wrong receipient to keep/open the item (it wasn't for unsolicited sent to them (as in addressed to them)), but they could probably make in hard on the PO to collect it back if they wanted to.
Again, insist this is resolved today. Otherwise you're going to continue to play telephone tag and leapfrog from day to day with nothing getting accomplished. If the carrier is already out, they may not have officially contact with the carrier until the end of the day. Get them to handle it specifically by somebody else. Figure out your own solution to this if necessary and get them going. Depending upon them has already been demonstrably problematic, beyond even the misdelivery, as it is already so many days past that.
