Hello everyone, I won an auction on the 7th, and thenseller never marked the item as shipped, and has claimed he lost the tracking number. It was very hard to get him to respond, and when he did he just said "give me your name". I am very concerned I have been taken advantage of. He does have a 100% positive feedback rating though.
I initially became very suspicious at the fact the item was never marked as shipped, and that he lost the tracking number allegedly. He said he's asked ebay to step in because he didnt like my tone. it took him 2 days just to tell me he lost the tracking number, his communication has been very poor. I dont know what to do here. Just wait? what will ebay do?

It's pretty silly of the seller, I mean what are they going to do, tell ebay that they don't have a tracking number and they don't like the buyers tone? Then what? Then nothing. Sounds like a intimidation bluff. As stated above, follow those directions to file a claim when appropriate.

On the day after the item is due to arrive, the estimated delivery date, if it's not there, open an INR case in the Resolution Center at the bottom of most pages. If the seller can't provide tracking or proof of delivery, after 3 days, I think it is, go back to the case in the RC and ask eBay to step in. You'll get a refund fairly quickly. Oh, and don't bother corresponding with the seller anymore, he's not going to help.

Open an "item not received" case with eBay. I've seen this happen sometimes, maybe he is not on eBay every day and was selling something and just forgot about it. If seller doesn't respond with a tracking number within 3 days you can ask ebay to step in and help and they will give your money back.

The tracking number protects the seller, not the buyer.
The buyer has eBay's Money Back Guarantee. It's seen in every listing and you need to read it.
If/when the item has not arrived by a few days past its last estimated delivery date, you can open an item not received case in the Resolution Center.
What kind of case could the seller ask eBay to "step in" for?

As @soh.maryl has said all buyers have the eBay MBG. It’s pretty clear you haven’t read this although it is on every eBay listing page. Not being aware of your rights as a buyer will allow unscrupulous sellers to take advantage of you.
