Sold an item. Buyer said it was damaged and wanted to return. Was a bulky item and the buyer agreed to file an insurance claim. Get home yesterday to find the package on my doorstep. Got an email from ebay saying this case is closed and the buyer will recieve money back. I go to file the insurance claim myself and cant because there is already an claim in. Filed a dispute with Ebay. They see nothing wrong. Just the same old **bleep**. Good riddance.

Was this a USPS insurance claim filed through the usps.com web site? I thought that it was possible for both parties (sender and recipient) to file a claim, unless one of them had already been paid. The USPS manual has a policy about dual claims, which wouldn't be necessary if such filing was impossible:
5.5 Dual Claim
If the mailer and the addressee both claim insurance and cannot agree on which one should receive the payment, any payment due is made to the mailer unless the claim has already been paid to the addressee upon presentation of the original mailing receipt.

FEDEX. I cant file a claim because the buyer already did. Ebay is a a safehaven for crooks.

It does sound like your buyer is a crook who intends to double-dip.
Is the item actually damaged? If not, you can resell it and probably recoup most of the cost of the original transaction.
For future reference: Never ask the buyer to file the insurance claim. As you have seen, they will get a refund under eBay's buyer protection policy, which they call the "Money back guarantee."

Doesn't FedEx consider that you are their customer, and not the buyer, and so will be paying you the seller ??

FedEx will only pay the shipper on an insurance claim.

That's good to know! I've never used Fedex, so I had no idea. If that's true (and I have no reason to doubt you, Sam) then the seller will get the last laugh here: He'll benefit from the claim that the ill-intentioned buyer filed. Or maybe the buyer knew that already and was just trying to be cooperative? Maybe.

UPS and all other couriers will also only pay the shipper on an insurance claim.
USPS is the oddball that will pay the recipient if the shipper agrees.

USPS will pay a claim to a recipient regardless of what the shipper thinks of it, they don't even contact them.
I made a claim last month because a gift I received was smashed to bits. When I filled out the form online, it asked the name and address of both parties and telephone number was optional. It also asked who was going to be the payee, and I put my name. The sender never found out that the wonderful gift they sent me was trashed by USPS.

So where did the Buyer do any wrong here? He recieved a damaged item and chose to use the Ebay tools and made a return? So...He didn't want to deal with the insurance claim? Ya...I wouldn't either.

The buyer filed an insurance claim and then also returned item for refund and ebay refuses to do anything. If you see nothing wrong with this, then I hope Im never unfortunate enough to do business with you. Ebay doesnt seem to mind and Ive removed all my auctions.

Why would ebay mind? What do you think they can do? FedEx is going to send you a check. Not the buyer. The buyer got his refund from you. FedEx reimburse you. It sounds like you told the buyer to file an insurance claim. Which he did. Had you handled this correctly, you would have refunded him and filed the insurance claim yourself.

If it's a claim that pays you, I'm not seeing how that would be a bad thing?
Was the item returned through eBay with you paying the postage? Or through FedEx as part of their claim process?
