I sent a package to a buyer USPS Parcel on 1/17/18 - which ended up delayed with no tracking after 1/25/17 (for almost two weeks). Buyer contacted me last week - checked with his PO and I checked with mine and was told Parcel Post can be delayed. Buyer was kind and agreed to wait until 2/5/18 before requesting a refund. I also started a missing package claim with the USPS. Now, as of 2/6/18, package has been scanned in same state as buyer. I don't have an issue with refunding the buyer, but it seems package has a good chance of being delivered this week, finally. How should I handle the package being returned to me? Buyer can't have both package and refund...not sure how to proceed.

Why would it be returned? It hasn't been delivered yet. If the buyer refuses delivery, he loses buyer protection.

Why would that even be an issue? Even if the buyer has already filed an Item Not Received against you, you still have a little time before he can close it.

Buyer would like a refund, has been waiting for package for 3 weeks, since it is past the expected delivery date I thought that buyer had a right to request refund according to ebay rules...they haven't filed anything with ebay yet.

If they haven't filed a dispute yet, there is nothing to worry about yet.
The best possible outcome for both of you is that buyer gets the package, despite the delay. Looks like that's close to happening.
