I have a buyer requesting return. I have it as no returns and buyer pays return shipping. There's a ebay money back guarantee.
Buyer says it arrived damaged. I talked to USPS and they said if a package arrives damaged they mark as damaged on scan and on tracking. Nothing was marked as damaged, though buyer says it is. Red flag one.
Red flag 2 No photos of damage. Also a message saying," I'll throw it in trash if you'd like or send it back. If I don't revive credit I'll be forced to escalate case. "
Red flag three this buyer isn't messaging me after 3 messages and 2 days.
So, question is will i win this case when it goes to ebay.
I have 12 photos.
Worked and was packaged well when I shipped
S/N is in photos.
Buyer has no pictures of damage.
Buyer is not messaging me 2 days.
No damaged tracking from USPS.
How will this turn out for me?
Will I have to pay anything?

Now would be a good time for you to read eBay's Money Back Guarantee for buyers.
Essentially, it says that, if a buyer opens an item not as described case, then escalates the case, you, the seller, will be either sending the buyer a prepaid return label, and refunding the buyer his/her total payment when you receive the item back.
There is no such thing on eBay as "no returns" and/or "buyer pays return shipping".
Do a little bit more reading please.

No.
Buyer doesn't have to provide any proof of damage.
If you let Ebay decide, they will refund the buyer from your account, let them keep the item and give you a defect for not handling the return.
If you want the item returned before refunding, accept the return and provide a return shipping label.

That's if i lose. Someone just can't say, oh it's damaged lol, then get money back making the seller pay the huge shipping amount. What if you sell a 1000 dollar card and they switch it with a fake. You just lost 1000. It's not a not as described case, it's a item damaged case. So...

I don't know what you sold, but if it is something that is fragile (glass, ceramics, etc.), then it can break in shipping due to G-forces. I've never seen a damaged package indicated as damaged by the USPS ... maybe they do this if they have to manually reseal the package.

The eBay Money Back Guarantee does not require buyers to provide photos ... it is simply activated based on what they state. However, if you are planning to file an insurance claim with the USPS, then it is nice of a buyer to hold onto the package for the USPS to inspect.

No. You have two options:
If you decide to battle the customer on this, then eBay will (a) force a refund, (b) allow the buyer to keep the item, (c) punish you by not returning your eBay sales fees, and (d) punish you further by giving you a nasty seller defect.
You seem to suspect fraud (I don't, but you do). As a TRS, if you had provided a 30-day return policy, then you would have some Seller Protections against buyer fraud/lying, but since you listed it with no returns then you do not have access to those Seller Protections.
(I'm not sure how you have it listed as "no returns" and "buyer pays return shipping" ... that doesn't make sense to me).

Umm ... yes they can. The Money Back Guarantee is used by thieves all the time to steal from sellers just like in the scenario you described.
Top Rated Sellers have some protection against these types of scams IF they list with 30-day or longer returns.

Sometimes USPS marks damaged.
Sometimes they just deliver it as they did this package.
Apparently the clerk sorting the packages, and the carrier delivering the item saw no deficiency.

If the buyer files a INAD claim, you either refund or supply (ebay supplies now and it gets taken out of your account) a return label and refund when it's returned. Doesn't matter what the condition, even if they return rocks instead of the actual product, you refund.
If the buyer hasn't opened a return request, (which it sounds like they haven't), you repeat
Return for a refund.
If they ask for a partial refund, repeat
Return for a refund.
If they say they threw it away, repeat
Return for a refund.
I've had those too, ain't we special?

if you've been sitting on this for 3 days, eBay is about to step in, you'll get nothing back and they'll refund on your behalf.
