Seller wants return and lying about damage to item

I sold a smart watch, buyer received it 2 days ago and now wants to return it for cosmetic damage. My listing stated no scratches and had a picture. He is now stating when he opened it it was scratched, even though it was delivered 2 days prior to this claim. He just requested a return ... if i have eBay step in to resolve it Bc i don’t have the money to return it what would happen? I need help !

Yes your  listing says no scratches on the face but the one picture does not clearly support that.  Black is a  hard color to show details but with some photo editing one can  do it.

In a nut shell if your buyer opens an item  not as described (INAD) case a very good possibility you will loose the  case and have to fully refund and pay for  return shipping.  eBays money back guarantee protects buyers for 30 days  after the receipt of the purchase even though you  have a no return policy stated in your listing & PayPal will protect the buyer  for 180 days.

 

Having no money to refund or  pay for return shipping is a problem for you should  have to refund about $160.00 or more).  I don't  have any experience with this situation but I always left $ in my PayPal account to cover returns - maybe another member can chime in.

 

The only thing that I can see that  is in your favor is the  fact the buyer gave you a very nice positive FB - stating the item  was as described & you shipped  quickly.

 

You best bet is to try to work out a solution with your buyer via eBay messages (be professional & non emotional) before getting eBay involved.

Thanks for the input. I do have pictures in my out box that i sent to another potential buyer with more pictures of the face. Should this turn into something, and i have more pictures do you think this would be helpful? 

Im clearly not a shop here on eBay,  just sell random stuff and now I’m getting screwed by this guy who just started buying on eBay.

On eBay, there is no such thing as "no returns, all sales final" ... your "no returns" policy does not mean that the buyer cannot get a refund from you if they claim that the item is not as described.

 

From what you are writing, I am assuming that the buyer has opened up a return with the reason "Doesn't match description or photos".   If this is the case, there is nothing (much) that you can do ... you accept the return, you wait to receive the item, and then refund the money to the buyer.  The cost of return shipping will be billed to your eBay invoice.

 

And, more to the point, it doesn' matter if the buyer is lying or not ... you still have to refund the money.   (Your bigger concern should be that you receive back what you sold.  As an inexperienced seller of high value electronics, you are a target for thieves.)

 

Now, if the buyer is sluggish and doesn't initiate the return in 5-days, you can call eBay and ask them to close the return in your favor since the buyer didn't return it.  I've been successful with getting some Customer Service Representatives to do this, and other times they put me off for a few more days.

No.  eBay does not accept such evidence since they have no idea when it was taken, or if it is even of the watch that was sold.

Yes say i get eBay involved and they side with him. How does reimbursement work to pay back eBay? As stated prior i dont have the money to do the return.

If you do not voluntarily refund the buyer, then eBay will do it for you.

  • eBay will first attempt to withdraw the amount from your PayPal account.  Without money in your PayPal account, I believe you will then get a negative balance with PayPal.  According to PayPal, if you don't have money in your PayPal account for a refund, then PayPal will attempt to withdraw the money from your bank account that is attached to your PayPal account.  
  • If there is some problem with the PayPal refund (e.g., insufficient funds in bank account), PayPal/eBay will reimburse the buyer out of their own pocket.  Then PayPal/eBay will come after you for the refund amount ... maybe suspend your account ... maybe get a collection agency involved.

 

I would advise against attempting to combat this return because YOU WILL LOSE with something like 99.9% probability, and not only will you be forced to refund the buyer, you will also lose reimbursement of eBay and PayPal fees ... which, for a $150 item will be another $20 loss.

eBay will not consider additional pics, they will only go by what is in your listing at the time of the sale.  You can add up to 12 pics at no added cost- just  your time

Orangehound  is spot on with his comments - he is  someone you can trust but like all of us he  can screw up too at times - I know I do (lol).

My suggestion at this point is that you do contact eBay via telephone - see " Help & Contact" tab a the top of the Overview page.  Don't go  by what the  first  CS rep says to you, get transfered to a escalation "expert" and  challenge the buyers case.  Your strongest  defense case is the great  Feedback the buyer sent you.  it totally conflict with what he/she is saying right now - ie when  I opened the  box it was scratched - hmmmm.  if this statement is in an eBay message tahtwould be a good thing for  you IMO.  Hopefully teh eBay 'expert" will  side with  you.  By all means be nice & professional & truthful in your converstion with them. - bite your lip if need be - you want eBay to over rule the  buyers claim.

I understand your situation & have been  in tight  $$ situations more than once in my life time - it is frustrating for sure.

possibility exists  this  buyer is trying to get you to  make a partial refund for the "scratches" - DON'T DO IT.  They maybe "trying to run a game on you" a.k.a.  a scam.
