Seller told me they won't accept return, do I still need to wait to escalate?

The seller has told me they won't accept my return, despite me showing photos of the item being fake. Do I still need to wait to have Ebay step in to help?

Yes, read the rules contained in ebay's money back guarantee,  & follow them.

No, but you only have one opportunity to create a return case so choose carefully. If you select item not as described, because you are saying it isn't as you feel this is a fake, then seller will have no choice but to accept your return. You should stop communicating with this seller as they are being difficult with you. Just follow the procedures on your return and when you receive the return label make sure you ship it back within the timeline or you will lose the case and your money. Best of luck to you....

The only other thing is to make certain you get an ACCEPTANCE scan or PICK UP scan.  Once it is delivered, you can check the case status, and eBay will tell you how long the seller has to refund you.

Once this times out, if the seller does not respond, escalate to eBay.
