Seller stalling on me or what??

So on Feb 12, I won an auction to the tune of $51.74.  I paid promptly.

 

As of Feb 20, I get this message from the seller:

"We had a sudden death in the family the aunt that raised both my brother and I passed away suddenly we had to go out of state to make the arrangements and we haven t stopped crying soon as I can get back home I ll email you when I m able to send it out thank you for your help John"

So, I wait a bit longer, b/c I'm being a decent person.  

 

On Feb 24, I get this message:
"The aunt that raised both my brother and I passed away suddenly we're out of state right now making the arrangements and settling her affairs as soon as we get back home I'll be able to send out your toy and e-mail you thank you for your help John"

 

Note that the seller has told me a few times that I'll be able to send out when he gets back.  However, he had the item listed as "shipped" on the order details.  

 

Today, Mar 8, I get this message:
"My brother and I are out of state right now trying to settle our late aunt's affairs I'm trying to get home later this week and when I'm able to send out I'll email you .this is been a trying time on my family thank you for your help in this situation John"

 

Still that same message, and I'm kinda over it at this point, to which I reply:
"Hi again.

The more and more I think about it, I'm going to ask for a refund at this time. You haven't even shipped the item, even though you've listed it as "shipped" on the order details. That is pretty poor form honestly. I'm sorry if you're having family concerns, but the right this to do is list yourself as "Seller is Away" or something like that.

Your auction lists this statement: "Will ship within 5 business days of receiving cleared payment- opens in a new window or tab. The seller has specified an extended handling time for this item."

You do realize in 4 days, it will have been a whole month since you've had my money for this item. Note too, as a seller if you cannot make necessary arrangements to ship out during this time, then you shouldn't be listing any items during this time. (You have 13 active items listed now. Imagine how those buyers would feel if you're unable to ship for over a month).

In the time you spent to reply to the other messages, you could have refunded me.

So, I want a refund now. Thanks for your time."

 

The item, per order details, list shipping time ranging through Mar 12...so 4 days out.  But you [he] still hasn't shipped the item, pursuant to his emails to me.. and I'm curious to see why I should get it even then..  Note, too, that Mar 12 will be one entire month since the item ended and payment was made.

It would be in your best interest not to have any more contact with the seller.  The day after the delivery date passes go to the resolution center and open a case for item not received.  Should the seller contact you after the case is opened just ignore the messages.   They may try to stall the case or try to get you to close the case.  Keep the case open until you receive your refund.

Absolutely open an Item Not Received Case the minute the delivery date has passed.

After having experienced two unexpected deaths in the family this past year, I can understand how things get a bit messed up.  However, my advice is to file a INR dispute the day following the final day of the estimated delivery period. 

 

I would probably send the seller my condolences for their loss though.

Not sure why you're wasting time on messages.

If the estimated delivery date is the 12th, open the item not received case on the 13th.

It doesn't make any difference that on March 12th it will have been an entire month since you paid.

You saw the estimated delivery date when you made the purchase.

Evidently you were willing to wait til at least March 12th or you would not have bought the item, right?

Well there's always [at least] one person who comes in with the catty feedback.  Thanks for ostracizing yourself.

 

Anyway...  The auction never listed the 12th as the estimated delivery time.  This is what was on the order details selection after the seller erroneously flagged the item as "item shipped".

Update on this.

Pursuant to everyone's feedback, I filed the INR case immediately on the 13th. The seller didn't even make a single response until today (the 18th) saying only "I'm working on this".

Tomorrow is the 19th, and I'll be asking eBay to step in for me.

You'll need to do that, yes. I see virtually no chance of your getting a refund from the seller. It will come from eBay as soon as they "step in," and then they'll go chase the seller to get reimbursed themselves.

 

As for that March 12 estimated delivery date, it was probably just a sliding-window estimate that incremented every day that the seller failed to ship. It only stopped at Mar. 12 once they marked the package as Shipped, which apparently it wasn't, as I assume you have not seen a tracking number shown for your purchase, and seen no evidence that anything is really on its way to you.

Ok, I asked for eBay to step in, and wow.. it like came down in a manner of minutes.  And their reasoning was "seller provided invalid tracking information".  Unless that's a canned reply, that is mind-boggling.  


Anyway, thanks for everyone for their help in this matter! 🙂
