Seller refuses to ship item, quit communicating, and won't refund. eBay isn't helping either

I purchased a computer for my son for Christmas on December 6th from the seller, Micomp. It shows he has a 3 day holding before shipping which was fine. On the 9th, he submitted a shipping label. A week later, the tracking never updated as it was never dropped at UPS for shipping. I contacted him, no answer, so I opened a case. He immediately responded and said he would ship that day, on the 18th, with 3 day shipping and it would be arriving on the 21st. That day rolled around, the shipping still not updated, he messaged me again and said there was an issue and it looks like the package got "lost" so he would send a replacement that day but the item would be delayed due to holidays and would arrive the 27th. He assured that it would be sent immediately and was very polite about it. I agreed and accepted then closed my case assuming good faith. Big mistake!! Here it is the 27th and still the item was never taken to UPS or shipped.  Now I can't open another case because eBay has dumb rules on that. That seller stole my money and eBay won't help now. This was a gift for a kid. I feel like I have been royally screwed by eBay for not helping at all, the seller stole my money and ruined this gift for my kid and they don't even care. I went through Paypal a week ago to resolve this and eBay has not responded to them either. What a joke! Over $300 gone because no one cares to help. After I get my money back, if I ever do, I will never use eBay again.

Go to Paypal and open an item not received case, the transaction will be there.

Sorry It’s important to know the rules/policies so a seller doesn’t try to take advantage of you like this.  Once you close a case you cannot reopen it.  Never let a seller talk you into doing that.  You should have no issue getting a refund with PayPal just don’t close the case!  eBay will not respond to that case they are not involved in PayPal disputes.  Be sure you escAlate the case to PayPal to decide and don’t let it time out

If you paid by credit card, you can always do a chargeback.

The lesson should be that you would never buy from that seller again. WHy do you blame ebay. You don;t even need to know the rules, just follow very easy steps that ebay provides for every buyer. Even if you don't know where to start, simple go to help and find the subject, i.e. item not received. You click on the link and confirm that you have not received the item and ebay will tell you what to do. Ebay is at no fault here whatsoever. Sorry to say, but you can only blame yourself. It was you who provided false information by closing the case. Ebay is just taking your word for it and you don't like it.

 

One thing you can do is to contact the police department in the seller's town and also open a case via USPS. It is a federal crime. You can also use the FBI site to report computer fraud. Open these cases, I think it can be done online, and send the seller the links or other pertinent information. He will send you your merchandise or refund you promptly, trust me.

Keep bugging Paypal. Get them on the phone and make them resolve it. But be nice as it goes a long way with them. Tracking is your best friend in this case as you never received it so there is no tracking.

Similar situation...trying to get a refund from a seller and ebay is awful. Just had to call long distance (over us$5) to get assistance. They seem to want to frustrate persons with issues into giving up. Will never do business with them again!

Why, why, why did you close the case? You hadn’t received the package or the refund yet you just told eBay you did. I hope PayPal comes through for you.

I truly hope this works out in your favor but why did you decide to ignore eBay‘s warning not to close the case until you had received the item?

Yes, they did.

These kind of stonewalling scammers really bother me. They love to take advantage of trusting people. 

I hope paypal gives you justice, and like others said, you can file a charge-back with your credit card if that's how you paid. 

 

If you can, please update when paypal takes action.

Why did you phone?

Did you start with the Resolution Centre at the bottom of this page (and most eBay pages)?

That would allow you to open a Dispute for Not Received, although if the seller could supply proof of shipping, there could be a delay to allow for Proof of Delivery.

But if there is not proof of Delivery the seller automatically loses the Dispute and you are refunded.

 

Paypal is your second line of protection if for some reason the eBay dispute does not work out.

  • Usually because the seller persuades the buyer that she has to close the case to get the refund OR because the buyer waits past the deadlines.

And finally if the Paypal dispute (which can be opened at any time after payment and has a 180 day window for opening) does not work either, which is unlikely,  you have the credit card you used to back your PP account. Phone the 1-800 number on the back of the card and ask about a chargeback.

The seller you just mentioned is a TRS with questionable feedback. Always read over a sellers feedback before purchase. Don't blame eBay, it was your mistake for closing the INR case.

Here are some basic rules when buying on eBay.

 

Vet your sellers, double down and check any other social media sites for the ID if you are looking to buy anything in high scam categories.

 

Follow eBay rules to the letter. If something can go wrong know how to best protect yourself.

 

NEVER assume or take anything on faith. If you position yourself as a doormat someone is bound to walk all over you.

I phoned because the phone back option is only limited to 2 countries and there was no email listed! Finally got an email address and all they do is send links.  I do not need to return the item I agreed with the seller to keep both phones and asked to be reimbursed the price difference  along with the cost spent on accessories for the higher priced phone that didn't come.

I have now official made a report with PayPal as ebay is **bleep**.

Will stick to Amazon in future!
