Seller lied to me....

about a cancellation.

I bought an item by mistake, I sent seller a message apologizing and if possible requesting  to cancel.
Seller wrote back almost immediately, not to worry the order was cancel and I should get my refund, might take a day or two.
One day passed and the item showed not cancelled yet, I wrote back is not showing as cancel yet. Got reply, not to worry is canceled. 
Now two days later and two more messages (total 4), saying order is cancel not to worry, it shows shipped. 

Seller is in China, returning the package would be an option, but I have to pay the shipping back plus a 15% re stocking fee.

If they would have ignored my request or say no, I had to accept it, but why lying? Do I have any recourse?

Seller lied to me....

Five quick things:

  1. The item is not cancelled ... the seller is lying, which means the seller is dishonest.  No need to interact any longer with this seller because they may mislead you.  Sellers like this often try to get you to take an action that harms your rights with eBay.
  2. If the item is coming from China, it will likely not arrive.
  3. eBay provides you with an estimated delivery date.  If the package has not arrived on that day, then file an Item Not Received claim in the Resolution Center.
  4. An item that is marked as "shipped" is not necessarily shipped.
  5. Even if the item should need to be returned, the return location is supposed to be the location in the listing (and not China).  Also, sellers on eBay cannot charge restocking fees.

No.  Seller is not required to cancel even if you ask and unfortunately, your seller lied and said she cancelled.  But that is not a policy violation.  You will have to accept the item and if you want to return, pay return shipping.  eBay does not allow re-stocking fees.  Give this seller appropriate feedback and don't buy from China.

Thank you so very much! You have been a big help.

In the future I intend to check not only where item is located, but where seller is located.
