I bought an item on May 27. I still have yet to receive the item and have messaged the seller multiple times. They have apologized saying that they will be out of state until the end of the week. That was 2 weeks ago. I have sent a reply to that message saying thank you for the reply and that it was fine. But afterwards, no reply so I messaged them on the 12th because I was wondering what was taking so long and that it is a present for someone that I need this week. I messaged them two days ago just to tell them that it was nearing the 30 days (8 days left) that I have ordered the item and that I will be requesting for a refund on the 30th day if they cannot send it. Should I wait until its the 30 days or should I just request now?

If it is passed the estimated delivery date, which is sounds like, there is no point in waiting, just file it.

An Item Not Received case can be opened the day after the Last Estimated Delivery Date and up to 30 days past that date.
You have given the seller plenty of time. Waiting until day 30 past purchase date could possibly lose you the opportunity to make the claim (if you miscalculate or forget).

You could have opened an item not received case when it was a few days late. Don't understand why you would wait until it's dangerously close to the deadline for filing. Have you not read the Money Back Guarantee?
