Scammed and now trying to get money back

So about a month ago now I bought a phone at a price which seemed almost too good to be true. I used my best judgement and decided that it was just someone who genuinely didn't need the phone and wanted to pass it along to someone else for some quick cash. After purposely refraining from shipping the item for a full two weeks, they shipped it and I finally recieve the phone to find that it's blacklisted. This confirmed my suspicions about it being a stolen phone. The seller claimed to accept returns, and after ignoring the request for a week, ebay automatically sent me the return label.

 

My question is: what do I do before I send it back? It seems like a bad idea to ship something so valuable back to someone who tricked me out of my money in the first place, especially considering the fact that they've ignored all contact I've tried to make with them. The last thing I want is for them to get the phone back, and then pull something else from under their hat in order to secure the money for themselves.

You're in eBay s hands now.  Follow their directions.

Ebay's money back guarantee has rules that a buyer must follow, regardless of any concerns that you have, you must comply with the MBG rules to have ebay secure you that refund.

You do have choices to make.  You can choose to follow the instructions you have received from Ebay, ship the item back to the seller within 5 business days of receiving the return label.  Once the item shows received in the tracking by the seller, the seller has a couple of days to review what was returned.  If the seller doesn't issue the refund in a couple days, Ebay will step in and force the refund.  That is what will happen if you choose to follow the instructions by Ebay.

 

If you are too fearful of sending the item back, as you have described.  Then after 5 business days have passed and you haven't shipped the time back, the seller can contact Ebay and have the claim closed for non-compliance on your part.  You will then me out the money and are free to keep the phone.

 

I really do understand your concerns.  But you can't have it both ways.  It would be completely wrong to allow you to keep the phone and get your money back too.  You can do one or the other, just not both.
