I have found out that ebay does not care if a buyer attempts to sell an item that they requested to return. I sold an item for $130. Buyer didn't look at photos fully then claim Not as describe/Doesn't match description. Return was automatically opened. After the return was open, that buyer attempted to sell the item at a much higher price. With no luck that buyer then cancels his listing and mails back my item 1 day before the deadline. If this isn't misuse of returns then what is

I could have sworn I read one of the guys on the eBay team say somewhat recently that if a buyer listed the item for sale then they voided their MBG protection. Can you weigh in on this @Anonymous ?

 

Is this case different because of the timing - the return was accepted before the buyer listed it for sale therefore the seller is still required to accept the return?

I am not aware of any rule that says a buyer who tries to sell an item cannot return it if they fail. If I am wrong, I hope someone will come along and enlighten us both.

I have auto returns set up and once the buyer requested it the return was opened. 3-4 days went buy with no activity on the tracking number so I visited their ebay page and found the item they were wanting to return was listed on their ebay page for sale. I know for a fact it was mine due to certain damage on the item. Their item had the damage in the same spot as well. Ebay wouldn't acknowledge that it is the same item and said there is no policy preventing the buyer to try and sell the item before the return deadline.

Hi @wastingtime101, we may have protection options for the seller if their buyer has listed/sold the item they received but we would need to be confident that it was the same item they ordered from the seller (either due to the item being one of a kind or some sort of confirmation from the buyer that it is the same item they ordered from the seller). In a situation like this, I would recommend that the seller contact Customer Service to have their concerns reported and reviewed.
