Returns/Refund, sellers time limit to issue return label

I recent purchased an item listed as new but when I received the item it was not. It was used and damaged. I started a return and the seller issued a sale price refund. I escalated it with eBay (to receive a full refund) . They found in my favor and gave me a full refund . 
from what I understand the seller will be responsible to issue a return label if they would like it back. How long do they have to issue this return label? Or is the case closed and I simply hold onto the item? The item is small and cost less then the S&H.

I'd say your seller won't chase any more good money after bad. I'd consider it a gift unless the label comes.

That’s what I was thinking but I wasnt sure if there’s a limit to how long they can wait to issue one. While the items damaged and used it is still usable and I don’t want to use it if I have to return it at some point. Thanks for the help.
