PLEASE HELP ME!! I bought a cellphone and I recieved it with a software problem so I opened a case up and sent it back with tracking info and I asked for my money back or another new phone of the one I purchased. It's been over 3 weeks and I've not gotten any response out of the seller. The seller has the cellphone back and they never returned my money. Can someone please help me figure this out. I don't know how to contact Ebay. I keep trying to find ways to contact anyone for help. Please help.

It is good you are here asking for help! Sorry that you had an issue with a seller! It stinks when things do not go as planned and it can get frustrating working through the return process. IF you follow the rules, the ebay Buyer Protection Plan will have you covered and you will get your money back! But the devil is in the details - you have to follow the rules and play the game that way (no short cuts).
So as OP noted there were a few details that were asked about, that could make a difference. So let us know and we can direct you in the right direction.
It sounds like you are on the right track and if the "details" match then all will be well. IF everything was done per the "fine print" of ebay rules then you should be able to ask ebay to step in and issue a refund. They might give the seller a few days to act on his own, but if the seller doesn't refund, ebay will issue the refund from the seller's funds and the seller will get a defect on his account for unresolved case.
I noted in your post you mentioned one option would be to get another phone or the one you purchased back. At this point, IF the seller has not been responsive, it seems like getting a refund is the best way to go. While most sellers are honest, when you do run into an issue, it likely makes sense to end the relationship with that seller and move on. Ebay can not force a seller to ship another phone, nor force them to fix a faulty one that was returned. At that point, just get your money back and move on.
er, that is unless this is a LARGE corporate seller that has repair facilities or a huge inventory and can just send another new phone.
So let us know,,, and likely as OP mentioned, you'll just escalate the case - ask ebay to step in.

Did you @michilebeasley2 select that you want a replacement phone when you started your return request?
Then your seller will ship your replacement phone right after you print the free return label and put your bad phone in the mail.
